Court upholds Captain Dragan extradition appeal

A Sydney court has upheld an appeal by Dragan Vasiljković, better known as Captain Dragan, against his extradition to Croatia, where he's accused of war crimes.

There is no expiry date on a War Criminal. We Glinjani know what he did, we aren't stupid. If I had to list the atrocities committed by Knindze & Siltovi I would run out of room on this page. He will be brought to justice believe me.

I see 'Roberto's been busy trying & convicting this man on the basis of heresay, which is basically all that that link he provided contains, & I would imagine all that any of the other 'many, many engl lang news stories' are as well - probably all drawing on the same two 'witnesses'.

In any event, will know more when the verdict is handed down in the defamation case against that one paper that took 'hearsay' a step too far.

With regard to Dragan's successful appeal against extradiction, will just make a couple of points.

Human rights advocates in Australia (as opposed to the likes of 'Roberto' above) have challenged Australia's extradition laws as these laws automatically grant extradition upon a foreign country's request (such as Croatia). As things stand now, it is up to the person being extradited to appeal against these decisions at their own cost while at the same time being detained pending appeal.

And with regard to Dragans case in particular, the Federal Court heard that according to a 2006 report by the Organisation for Security and Co-operation in Europe, 29 % of Serbians who faced war crimes trials in Croatia were convicted, as opposed to 7.5 % of Croatians who faced trial on similar charges.

That is why his appeal was granted.

Then why doesn't Thaci come before a Serbian court to defend his apparent innocence? If Kapetan Dragan was responsible for any crime he would have been indicted by the Hague years ago - but he hasn't been, why is that? God knows hundreds of others have been - for lessor or worse crimes. This is nothing more than a blatant witchhunt enacted by the Croatian government to calm their hysterical masses after the Gotovina arrest.

Coming back to this so called Kaptan, I know unfortunately very little about this guy but I guess that the Australian court had a good reason to take this decision! If Croatia is able to make his case right am sure the Aussies will send him where he deserves!

Yes, Zoran. And considering how biased the Hague is againt Serbs, were he guilty of anything they would have screwed him back then. Furthermore, the man refused immunity because he stated he had nothing to hide. Glad to see they won't get him in Croatia.

He made the NATO court in the Hague look foolish when he testified as a prosecution witness but was later treated as hostile because he told his truth and subsequently defended Milosevic.
