Based on international law, self-determination when coupled with military power trumps soveregnity otherwise Serbia would have been still a part of the Ottoman Empire.

The current leaders of Serbia are lying to their nation about the reach of the ICJ decisions.

ICJ sorts disputes bewteen nations. By inviting Kosovo to ICJ as a defendant, Serbia automatically gave it national attributes.

ICJ has been put in an impossible position. If Kosovo is a non-state than ICJ can't consider it a party/defendant. Nor it can expect its decision to be consider valid by Kosovo.

ICJ's decision will be too vague for any side to consider it a loss. After that it will business as usual.

Serbia will press the countries not to recognize Kosovo because ICJ concluded that it's declaration was not valid. And Kosovo will call for other recognitions because ICJ cleared the way, by finding no breach of the international law.

No matter what countries will make their recognition decisions based on their interests and not on the ICJ outcome.

The only thing that ICJ may change is the political situation in Serbia. Will the charade continue? Will Tadic and Jeremic remain in power? They probably will. The Serbs are too deep in denial to get rid of them. They want both Kosovo and EU. Can't blame someone for wanting it all.

To MB from Ireland;
Now that's what I call classic input!
The whole Kosovo episode has been a complete farce from the outset. How any reasonable person in their right mind can go along with this US engineered charade is beyond me. If you follow US/BRIT logic, half the countries in the world would crumble into anarchic mono-ethnic sham entities. Even if 189.9 States recognised Kosovo, it still wouldn't make it right. The Albanian regime in Pristina is desperate for recognition from the mother State, which I sincerely hope it never achieves. Only then would it be legitimised in the eyes of the world.

"We paid particular attention to the thesis that Kosovo is a unique and sui generis case, and that precisely for that reason, international law should not apply in this case," he explained.
I think it was Mr. Solana who I first heard coming out with this pathetic notion that 'Kosovo is a unique and sui generis case'
There are very many UN member nations that have regions of their territories which are populated by majorities of non-natives.

Would these also have unique, sui generis cases if they were to do what the Albanian Regime in Pristina did? (with UK/US/EU help)

The ICJ just has to look at the ridiculous effort that the USA made in recruiting countries to vote with it in trying to block Serbia from submitting her case to the ICJ. I think they had five others; Albabia, the Marshall Islands and three other small little places that I had never heard of.

On the 17th of February 2008, International Law was broken 'sui generisly'.
