The declaration of Independence was not a spontaneous move by Kosova. The Court will look into the whole history of the conflict, war in former Yugoslavia, break up of Yugoslavia, the legal implications of some actions of leaders and others.

They certainly will. Especially resolution 1244, the Helsinki Final Act and so on.
