The ICJ is obviously the highest court of international law in the world, and after the UN General Assembly has asked for an option on Pristina's UDI, it begs the following question; after the ICJ rules in favor of Serbia's position, how will it react? Will it respect the rule of international law from its highest source, thereby agreeing to be bound by it voluntarily, or will it disrespect the rule of law and the ICJ (and thereby the UN Charter, Resolution 1244 and the Helsinki Act of 1975) and the UN itself, and show itself to be nothing more than an illegitimate outlaw region, which legally is Serbian territory. Pristina is scared to death of the ICJ's ruling because it will be based on the rule of international law. The West, on the other hand, will have no choice but to respect it.

Interestingly it was just yesterday that Serbs here were assuring themselves that Prishtina would never declare independence, let alone be recognized. I feel that they are setting themselves up for another disappointment.

@Olf:

don´t worry about my future, my dear!

I will be buying land in southern Serbia, and I will be buying it exclusively from Albanian owners!
we will see whether they will be so hard-boiled patriots, when they see nicely smelling dollar-bills.

I bet they won´t, and as far as I can see it, there are already several potential sellers wishing to earn money...

at least that´s what the real estate broker is telling me.

so the bottom-line is: we will buy you, and the rest of it will come back to us anyway, since it - remember it my dear - is serbian territory.

as for this comment written by "Ajsel":

my dear, you can write it as often you want, and no matter how often you deny it, deep inside you know that I am right.

historically, legally and morally ...all the facts speak for Serbia.

if it were different, you wouldn´t have needed dirty terrorist-tactics and US- and NATO-help to ( temporarily ) take over control of sovereign serbian territory.

Therefore, what the court rules in our case will set a precedent for every future attempt at secession throughout the world,” said the minister.

“That means that everyone will refer to this ruling. As a result there is great interest in this case in the professional public and among international legal circles,” he explained.

Well KOSOVA is a sui generis case and I feel that the Court will come to that conclusion. The Court quite likely might say Kosova's independence is a lesson for all rough and oppressive cointries that should you oppress "your own" people you risk losing these people and the territory where they live in.

"Serbia has a number of powerful allies on its side, said the minister, but so too does Priština.

"... the Kosovo institutions have prepared their arguments too. The Priština team’s documentation, headed by British international legal expert Michael Wood, contains two sections of around 500 pages each"

Not an easy ride Jeremic. You have no intention of accepting the Court decision if it goes against Serbia. But at the end the Court decision is ADVISORY/non obbligatory.

“This is the first time in history that the ICJ will be considering an illegal act of secession. Therefore, what the court rules in our case will set a precedent for every future attempt at secession throughout the world,” said the minister.
--------------

Can someone tell the minister that ICJ doesn't have any LEGAL power!
Therefore it can't considere as the minister put it "an illegal act of secession".
Serbia asked ICJ to expres an opinion and come up with an ADVISORY verdict. Somehow the minister in order to justify his incopetence and to keep Kosovo interest alive in Serbia, comes up every bizare sorts of claims.
Again the minister talks as Kosovo indepedence happen yeasterday not more than a year ago. So far Kosovo has not set "a precedent for every future attempt at secession throughout the world". Even Russia made it clear that the regions of Abkhazia and Ossetia are not the same as Kosovo!
So goodness know how the minister and his legal team are going to justify these claims in ICJ.

Unfortunately it is the Serbian way to change the whole world. Be it WW1 or Non Alignment or Kosovo prcedent. How does it comes that Serbs are so often the corner stone of the world politics ?

Abkhazia and NO are just the first flowers ! We are to rip a terrible harvest of multiple wars all over the world. Ian I would not deny that Serbian forces in Kosovo were heavy handed and there were cases of war crimes.
However, as far as I'm aware nobody seriously claims that it was genocide - certainly not the Hague or respected groups such as Amnesty International. In fact I don't think that even the Kosovo side at the ICJ will try to claim genocide, but I could be wrong.

If you are going to maintain a semblence of impartiality you will have to withdraw that claim or provide international based evidence to the contrary.

Seems that Jeremic’s concern is not Kosovo independence, he is much worried about the consequences that it might cause in the future for the rest of the World. He is constantly making statements on invalidity of the subject, the impact of various factors, weather forecast etc. same time pledging the readiness of his and undisputable evidences he does possess measured out in volume of the pages. That is OK, but classifying the case as historical Jeremic argues himself in his attempt by prejudging the whole outcome. In my opinion as a part in dispute Jeremic should wait for the final outcome ruled by ICJ who is the only competent body to come with the decision (opinion) after a thorough research in the most unbiased manner. So let us wait and see.

isn´t it amusing that our dear albanian friends here in this forum are not getting tired to express how unimportant and useless this ICJ-bid is... and on the other side, their "heroes" and "prime minister" and "president" ( of course only temporary figures ) seem to take it quite serious indeed.

either our dear friends here do not have a clue what they are talking about - or their "leaders" are doing something completely useless.

but if so, why are they doing it?

perhaps to let the average K-albanian believe that everything is okay...?

It was clear Serbia would go for this, since they haven't let out anything to harm us Albanians, beginning with repression during '80ies brutal assaults, war, burning down our homes and deportation in the '90ies. After loosing the war there was nothing left to you but use every political mean to make our lives as hard as possible. Maybee it is not comletely true when we say nothing has changed in Serbia, I'd agree you have a democratically elected government, but your positions considering Albanians and Kosovo are, as good as I can see, totally conform and unchanged to those of Seselj and the Milosevic regime.
