"will be examined"

WTF? So they are still not interested in "investigating" then? Looks like EULEX is trying to avoid this poison chalice with empty words or is it trying to buy time and if so, why? Could there be a behind the scenes political conflict occurring between these 'international organizations'?

It doesn't smell right.

With regards to the evidence destroyed by the ICTY, a very relevant point was made on the BBC radio yesterday:

When the ICTY takes evidence into custody, it is logged. When they destroy evidence, it is logged and a reason must be given for doing so.

This is official protocol for handling evidence in criminal cases.

The ICTY, curiously, has yet to inform anyone of what their reasons were to destroy the evidence.

Is this the same EULEX which is opening prison doors and letting Albanians out?
This is the same EULEX that Serbs are going to put their trust in to investigate. Even if they do seriously investigate they are not likely to report much.

If I were Serbian prosecution I would not be handing over any original documents to this mob. Make photo copies and only give them those as originals will not be able to be replaced.

A lot of things here are muddled and manipulated to fit into a narrative which then is being used purely for propaganda reasons.
The issue here is simple and straightforward: If there is evidence and facts, let the ICTY bring forward indictments for the guilty ones. There is no need to drag this indefitively. ICTY is fully capable to bring indictments against anyone in Kosova - remember Haradinaj was a prime minister of Kosova and he was still put on trial.
If there is no evidence and facts, then, making sweeping accusations, does not serve justice, but propaganda. Please note that Del Ponte - no friend of Albanians by any stretch - did not find sufficient evidence to support these accusations, although she had qualified and professional teams of investigators in her disposal, plenty of time and the full support of KFOR. She clearly states that in her book. Pretty much of what she says is: "We received allegations a, b, c, d etc., from certain sources. We did an onsite investigation. We had full support of KFOR at the highest level - offering air reconnesaince and what have you. However we did not find sufficient evidence to prove these allegations." OK, fine then.

The Serb prosecutor on the other hand, has not provided any evidence other than pictures of KLA solders and videos that are freely available on YouTube. It was classic how he managed to "discover" that is was Agim Ramadani that lead the KLA attack on the VJ base in Koshare, he must have been secretly reading KLA memoirs.

BBC report meanwhile, speaks only about prison camps and the use of torture in such camps. That does not automatically prove that such prisoners were used for their organs. BBC specifically said: "The BBC News investigation also studies claims that some of those held in Albania were killed for their organs." BBC "studies claims" does not mean that BBC proved the claims. In fact BBC did not provide any facts/testimony that proved these claims.

Well what can I say when it's not the Serbian propagandists spreading this information but the anti-Serbian BBC.

Here is what they said:

The BBC News investigation also studies claims that some of those held in Albania were killed for their organs, and that physical evidence gathered by UN investigators in Albania was destroyed by the International War Crimes Tribunal.

Here is the full article. Check http://newsvote.bbc.co.uk/1/hi/world/europe/7990761.stm

Now if that BBC investigation revealed the NATO court destroyed evidence then I say bring those responsible to justice.

Isn't it funny how it's Carla del Ponte and the BBC making these claims but Serbians still get the blame for spreading propaganda. Looks like some people just can't face the facts and would prefer to keep these horrendous crimes covered up. Yep, my dog ate the evidence looks like the excuse being used here.

Is good to see that EULEX has decided to proceed with the investigation although given the timing of the announcement, suspect it has more to do with the report by the BBC than any real desire on their part to follow this up.

And of course, if & when a case is put together by them, have the issue of the impartiality of the judiciary panel given that K-albanian judges will be part of it, & given that at least one of the alleged perpetrators holds a high position in the Kosovo judiciary.

Personally have a lot more faith in the EP's Dick Marty who has a proven track record when it comes to investigating causes that are unpopular with the establishment.

right:
> Sounds a lot like the "dog ate my homework" excuse.

Well in actual fact, ICTY did destroy the evidence gathered at the 'yellow house'. Happened back in 2005. Apparently, the ICTY regularily destroys evidence it no longer considers 'relevant' - which doesn't say much for the credibility of this court.

> No student ever got anywhere with that and neither will the Serbian propaganda group with theirs.

Unfortunately for those who share your viewpoint, it isn't just a matter of serb propaganda - see below.

> No amount of evidence will ever convince those who are desperatly hoping this tale is true that it never occurred.

And of course, the other side of the coin is that 'no amount of evidence will ever convince those who are desperately hoping this tale is false that it did occur'.

> But I doubt that you will ever convince impartial parties with any intelligence that it is possible.

In that case you won't mind if we let impartial 3rd parties make up their own minds.

>>>"Vekarić said that his office is "ready to help EULEX, and colleagues from Albania, regardless of the previous negative answers". The Albanian side did not wish to cooperate in the investigation into the illegal organ removal from prisoners in the north of that country."

We are deeply moved by your "support" Mr VEKARic. Rivers of tears are flowing from our eyes in sign of commotion from such extraordinary example of "solidariety".

There already was an investigation years ago, which del Ponte describes in 10 pages. It started and ended with unnnamed journalists which refused to reveal their sources. I wonder who these "journalists" (read mouthpieces) were hmmm?

>>>The prosecution believes that hundreds of Kosovo Serb civilians were kidnapped in the province in 1999, taken to northern Albania by ethnic Albanians, and had their vital organs removed."

What you believe is not proof/evidence. You will fail in all your initiaves like all the previous ones.

However there's one thing you will always prevail in : Making all news from the Balkans be negative ones, thus raising the animosity between our people, as well make the Westeners look down on us even more.

We have to remember that an investigation was already conducted and the NATO court in the Hague destroyed the evidence! This needs to be highlighted over and over again so those responsible are also brought to justice.

This was revealed in the BBC investigation so what is stopping the EU mission doing the same to protect their (and NATOs) interests in justifying war crimes committed against Serbians along with their support for terrorists on our soil?

Quite simply, I wouldn't be surprised at all if NATO supported organ harvesting while Carla del Ponte's conscience finally made her reveal these horrendous crimes.

Just remember that both Carla and the BBC have always maintained a very strong anti-Serbian position. Also, it's interesting to note that even those commentators here who attempt to preach justice and human rights still manage to spin this and blame Serbians. Really disgusting if I may say as it just demonstrates the true character of these fakes.
