It's all well and good to speak of good neighbourly relations and how all sides should think of that, but what do you do when you are being sued and you know that you have a stronger case against your neighbour who is suing you?

What is being ignored here is who threw the first punch. Serbia had every intention of repairing relationships and all was needed for the other side/s to acknowledge their parts in the conflict, but that was too much for some.

Now we have a case where Serbia has no choice but to counter sue. Everyone has the right of defence and reply. Why blaim Serbia for the court cases when it was the others who started them?

It would be unrealistic for anyone to expect Serbia to just take it on the chin. Have all those Serbs murdered and expelled but still be pronouced the villain and taken to court without the right to be defended.

Serbia has a moral obligation to all the Serbs to take this to court even without the others starting proceedings.

There is a lot of back and forth on this blog regarding who started the conflict in Croatia. Let me remind you that Croatia declared its independence UNILATERALLY (just like Kosovo) and thus violated the Yugoslav constitution. This is the breaking point. This is the offense from the Croatian side that started this particular conflict.

If they (Tudjman) instead negotiated on a solution with the Yugoslav government (at the time) a lot of bloodshed could have been avoided. But when you have great powers (Germany/US) on your side you feel like you can do as you please, like the rules (international law) somehow don't apply to you. Just as the Albos did with US help. Could they have taken Kosovo ALL BY THEMSELVES??? Don't bet on it!!!

There was no reason why Yugoslavia couldn't have continued to exist, perhaps as a mini EU, with a rotating presidency of Slovenia, Croatia, Bosnia, Serbia, FYROM. But NOOOOO, people got greedy (from all sides) and wanted ethnic homogeneity. There was also an economic factor to this as well as Slovenia was the most developed of the Former YU states. Support of RSK from Serbia should have been more than obvious since Croatia declared its independence unilaterally. Hell, if there was a sizable Serbian minority in Slovenia there would have been another RSK/RS type entity there too as Serbs were against the breakup of Yugoslavia.

Now that the history lesson is done with, on to the actual article. I think it is a great idea that they are counter suing Croatia as this is well long overdue, especially as nothing was done regarding the WW2 Ustasha crimes. These crimes have to be answered for, as Tito simply ignored them when he took over.

Hopefully when this is all over the two nations can go back to restoring relations with each other, however by going through with the ICJ case, both Serbia and Croatia just made that road longer and more difficult for themselves.

Viti i Balit,

Serbs in Croatia and Krajina were killed and expelled by the Croatian Army and local civilians. That has nothing to do with the Yugoslav military's presence in these areas. Unfortunately, Croatia reignited the horrible crimes that many Serbs remember from WWII and many thousands of innocent Serbian Men, Women, and Children were killed in the early and mid 1990's. My father-in-law's only crime was that he is Serbian. Did this justify his torture for 7 months in 13 different Croatian concentration camps in the early 1990's? Do a little research and you will find thousands of Serbian names online, names of innocent people who were killed due to Croatian fascism. I invite you to search for Croatian names as well. The interesting thing is that they are much more difficult to find.

For those innocent Serbs who were murdered in the 90's and for the 250,000 that were expelled from Krajina, I am so relieved that we now have a government in place who is willing to expose Croatian crimes and fight misinformation that is perpetrated by Western media sources. The victims deserve that and much more. I am confident that more truths will be exposed in the coming years.

If Jeremic indeed goes through and sues Croatia I am very much in favour of this.

If however this is another empty DS promise or make believe project- I guess it is my fault that I will be dissapointed.

After Jasenovac, it was the cardinal mistake to let Croats into a Yugoslav country. But finally the moment is coming to make them speak in Court. It should be known that all evil that arised in ex-Yugoslavia came from Croat nihilism. Thanks God we have a border with them.

Way to go Jeremic!

If we truly believe we have been wronged - let's show we are on the side of truth, clarity and intelligent reconciliation. Kosovo, Krajina, etc., should be confidently discussed in the open so that a historical and moral record is established for ourselves, for our children and for the future of the region.

Keep up the tough fight. We are with you!!

Mark Abrams: "Mr. Jermic and his patron have just condemned their children and grandchildren to carrying the burden of shame for many years ahead."

How exactly? What shame will this or the next generation of Serbians suffer? Or Croatians, Albanians or Roma?

And if so called 'collective responsibility' now extends down generations, then many of us from other nations also have our own collective 'skeletons'.

At last! It really is about time the truth is heard!

Funny that I didn't hear any criticism about neighbour suing neighbour when BiH and Croatia raised their cases? Now that Serbia intends to proceed with a counter case all of a sudden the "European" or "Good neighbourly relations" issue comes up.

Croatia has opened a can of worms with this stance and Serbia should now proceed full steam ahead and not accept any out of court settlements. The truth needs to be known.

BiH raised its case to save itself from Bankruptcy but failed and it seems Croatia is now in the same boat. Sorry to say but there is no chance Croatia will get anywhere and it won't be seeing any public Christmas events for a long time to come.

Croatia's case is justifiable,Serbia's is not.Remember war was hapening in croatia not in Serbia.Srbia send its army to fight in Croatia,Croatia was defending what is theirs, no case for serbia that amounts genocide.

Justice and Reconsiliation are often imcompatible. There were horrendous crimes commited during the Spanish Civil War by both sides, but they managed to geconcile after the war. The Germans and the French had lots of grievences, but reconciled.
Serbs and Croats failed the test! Both are acting selrightiously. Each of them is convinced the other maliciouslly tried to wreck "their country" (Yugoslavia for the Serbs, Republic of Croatia for the Croats).
Saddly for the region, Serbia was delayed in its EU integration because of the the predestined "Kosovo affair".
Croatia came close to the EU integration and ... launced the ill conceived suit. Serbia replies in kind.
The EU must state that the reconciliation with neighbors is an absolute requirement for adheasion.

Croatia will be a member of Eu soon! If you sue them you will have another condition (to drop the charges) added to the list of many in order to join EU ;)

It is a sad fact that suing your neighbour, be it the owner of the house next door or the country next door, is seen as "normal" behaviour here. If these are "European values" then I suggest the mature European democracies let everyone join the EU and then form a new union.
