The head of Serbia’s legal team objects to the decision to invite the Kosovo Albanians to take part in the ICJ case on the province’s independence declaration.

I really appreciate the fact that Serbia for the first time is trying to solve this particular problem by political legal means. Since this case is not binding Kosvars don't have to be concerned with the result of the opinion. The truth always prevails. Good Luck

In any democratic court both parties are allowed to present their own case and arguments.

Serbia strong case ? hm from here i can see how much you now about war in Kosova, Bosnia, Croatia, Slovenia.

(in coming days)Serbian Government now will Council ICJ.
So Republic of Kosova will go thru ICJ, and after will come Bosnia, Croatia.

Actually, since ICJ is an institution ruled by the UN, legally right is the Kossovo representatives to not be present in the hearing process since they are not a member of the UN.
That is legaly right. Ethicaly right, although I am strongly in favor of Serbia on this one, I find it fair for the Kossovo representatives to be invited in the hearing as long as all communities of current Kossovo province are represented. Because even if Kossovo today was an independant country, ther still is a big number of several ethnicities in there that would also should be represented since an independance case affects them all.

Amazing the amount of righteous indignation being displayed here to what is most probably a procedural point. Suggest you all re-read the last paragraph of the article before you blow your 'collective gaskets':

If ICJ overrules Serbia's objection as seems likely, fine. If it doesn't, K-albanians can still put their cases through US, UK proxies.

Personally don't care one way or the other, as long as K-albanians are not accorded the status of a nation-state.

As time goes on, Serbia's case can only strengthen as the truth gradually leaks out - such as for instance, the hoax of the 'Racak Massacre'.

What is the Albanian camp on about??? The ICJ case ISNT Serbia vs Kosovo, for if it was that, it means Serbia indirectly recognises Kosovo. The ICJ case is simply an advisory opinion on the legality of the UDI and as the ICJ is a UN appointed court, they will look at UN reports and documents, which are not written by any side (serb or Albanian). Therefore there is no need for either side to represent themselves as there is no plaintiff nor defendant.

UN member states may ask for an opinion of the ICJ at their will and since Kosovo is not a UN member obviously it cannot be allowed to participate (one of the perks of bieng an actual state). Although it seems UK will probably be used as its mouthpiece so no loss there.

So in your opinion Naru is important because they recognized Kosovo but Spain isn't because they haven't.
All we hear is how 51 most powerful countries have recognized Kosovo. How many of these 51 countries are powerful?
Most were bullied by the US to do that which makes them weak and non resistant to pressure.

But we all can tell what Serbia is trying to achieve, just to quiten the internal politics and public about Kosova's loss. Trying to deny Kosovo the elementary right to represent itself it is a DESPERATION turned into blindness.

I will quote here “Real Canadian” who refers to the ICJ chapter from the previous posts that tells everything regarding this issue, here we are:
"The primary purpose of the ICJ is to render opinions on international legal disputes between States".
So, what the process would be if the both parties involved were not invited to present their facts??? Does Serbia want to do like in the past (like in Berlin conference, London treaty in 1913 and finally treaty of Bucharest in 1913 in which Kosovo definitely was added to Serb territory). That’s simply not possible any longer, as Kosova is independent state recognized by 51 countries world wide, including most powerful and democratic countries in the world.
It is not a big deal even if Kosova would never be recognized by some countries such is Libya, South Africa, Iran, Indonesia, Serbia, Egypt – which we used to rule over for 200 years etc.

I think this Obradović fellow chose the wrong career. Why would Serbia do such a foolish thing?! ICJ already decided and his "unacceptable" issue will be disregarded given the fact that there are not too many norms regulating advisory opinions, hence the Court establishes the framework at its own decision. Moreover the Court gave the possibility to any UN state interested on the issue to submit their opinion, so it's clear that the reasoning behind the decision was that the Court wants to hear everybody's point of view.
Playing the victim and using theatrical moves won't help Serbia at all. The plea in front of ICJ is a matter that should be taken care of by top of the line experts and Serbia should present her (legitimate in my humble opinion) arguments irrespective of what others have to say, but taking into consideration also the interests and wellbeing of the present communities in Kosovo. In other words in cold blood with sincere care. Don't forget the fact that the judges probably know and thought of arguments pro and against, even more than most of the experts on this planet.

Case and Point: Serbia as a UN recognized nation, including Kosovo within her borders, has asked for ICJ ruling. So Kosovo is automatically included. But since Serbia has asked for the ruling they are the only one that should present the case. This is not the case of guilty or not guilty. It is simple opinion of ICJ if the whole idea of Kosovos UDI is legal, according to international law. Now, if Kosovo government thinks their UDI is legal they can ask ICJ for the same opinion. But in order to do that they have to go thru same procedures in UN. And since Kosovo is not UN recognized state, another country for example UK can defend Kosovos side. I can see Kosovo officials on the sidelines as advisers to UK lawyers, but not as presenters to the court itself. Which is most likely what is going to happen.

Does Serbia actually expect to (essentially) file a request for an "advisory opinion" against the Kosovar authorities and not allow them a chance to represent themselves?

Face it Serbia, Kosova is an independent country that will not only defend itself on the international stage, and before the ICJ, but will also attain IMF and World Bank membership next year, as well as more and more recognitions.

I would win any cause if the counterpart would not have a chance to speak and defend himself at all.

I could declare Sumadija as the heart and soul of the Albanian nation and claim it as Serbia did in London and Berlin's conference with Kosova when Albanians were NOT invited although it was decided their fate....

Actually I could even knock down Tyson if he just stays immobile and does not defend himself.

And with my friends we could win Manchester United- if they do not run.

This is beyond beleive! The Serbian government accuses Kosovan Albanians for all sorts of things in front of ICJ but doesn't wont them there.

Mr Tadic,Jeremic & Sasa Obradovic as educated man you should know by now that here in the western world if you accusse someone they have the right to defend themself in front of a judge & jury in personn or through a legal team.

You cannot accusse someone and at the same time ask them not to appear in court!!

Did you really think that ICJ would have considered the Kosova Independence without hearing Kosova's side of the story>

Who do you think ICJ is? A court in the outskirst of Belgrade!!

By objecting to the ICJ's Kosova invitation you are truly insulting the judgement & the procedures of the ICJ.

I could declare Sumadija as the heart and soul of the Albanian nation and claim it as Serbia did in London and Berlin's conference with Kosova when Albanians were NOT invited although it was decided their fate....

You cannot accusse someone and at the same time ask them not to appear in court!!

The ICJ case is simply an advisory opinion on the legality of the UDI and as the ICJ is a UN appointed court, they will look at UN reports and documents, which are not written by any side (serb or Albanian). Therefore there is no need for either side to represent themselves as there is no plaintiff nor defendant.

UN member states may ask for an opinion of the ICJ at their will and since Kosovo is not a UN member obviously it cannot be allowed to participate (one of the perks of bieng an actual state). Although it seems UK will probably be used as its mouthpiece so no loss there.

All Serbia has to do is bring Ranta`s and Carla`s books and case would be closed.
Judgments will come for albanians sooner than later.

I think this Obradović fellow chose the wrong career. Why would Serbia do such a foolish thing?! ICJ already decided and his "unacceptable" issue will be disregarded given the fact that there are not too many norms regulating advisory opinions, hence the Court establishes the framework at its own decision. Moreover the Court gave the possibility to any UN state interested on the issue to submit their opinion, so it's clear that the reasoning behind the decision was that the Court wants to hear everybody's point of view.
Playing the victim and using theatrical moves won't help Serbia at all. The plea in front of ICJ is a matter that should be taken care of by top of the line experts and Serbia should present her (legitimate in my humble opinion) arguments irrespective of what others have to say, but taking into consideration also the interests and wellbeing of the present communities in Kosovo. In other words in cold blood with sincere care. Don't forget the fact that the judges probably know and thought of arguments pro and against, even more than most of the experts on this planet.

So in your opinion Naru is important because they recognized Kosovo but Spain isn't because they haven't.
All we hear is how 51 most powerful countries have recognized Kosovo. How many of these 51 countries are powerful?
Most were bullied by the US to do that which makes them weak and non resistant to pressure.

Amazing the amount of righteous indignation being displayed here to what is most probably a procedural point. Suggest you all re-read the last paragraph of the article before you blow your 'collective gaskets':

If ICJ overrules Serbia's objection as seems likely, fine. If it doesn't, K-albanians can still put their cases through US, UK proxies.

Personally don't care one way or the other, as long as K-albanians are not accorded the status of a nation-state.

As time goes on, Serbia's case can only strengthen as the truth gradually leaks out - such as for instance, the hoax of the 'Racak Massacre'.

Actually, since ICJ is an institution ruled by the UN, legally right is the Kossovo representatives to not be present in the hearing process since they are not a member of the UN.
That is legaly right. Ethicaly right, although I am strongly in favor of Serbia on this one, I find it fair for the Kossovo representatives to be invited in the hearing as long as all communities of current Kossovo province are represented. Because even if Kossovo today was an independant country, ther still is a big number of several ethnicities in there that would also should be represented since an independance case affects them all.

In any democratic court both parties are allowed to present their own case and arguments.

So Republic of Kosova will go thru ICJ, and after will come Bosnia, Croatia.

I really appreciate the fact that Serbia for the first time is trying to solve this particular problem by political legal means. Since this case is not binding Kosvars don't have to be concerned with the result of the opinion. The truth always prevails. Good Luck
