This is not a UK style Royal Commission with defined set of terms of reference. It is a court that will make a ruling on an issue OF LAW.

Why the confusion?

As a country with a profound impact in its colonial world with its ideas on the rule of law and transparency and accountability of government the regimes from the UK have sunk to absolute new lows.

Your colonies stopped taking you seriously a long time ago it’s time for the rest of the world to follow suit.

This won't change a thing regarding Serbia's initiative (the crimes perpetrated by the UK on Serbia are obvious and should be pursued separately and successfully) but it is a clear message to the citizens of the Un-united kingdom that the good old days of certainty you thought would remain with you have well and truly gone.

This is one of many measures by which your own citizens will suffer and lose all that was built since the Magna Carta.

Yet another action in a long list that adds to the idea and reality that there is one law for me and another law (lawlessness) for others.

This notion will however be applied rigorously when the time is right and the shoe is on the other foot (might is right, eh).

You want to negotiate with the Taliban so it is an easy stretch with the K-ghetto.

'Kosovo is not in the UN and allowing them to represent their case would from some point of view mean precisely the recognition Kosovo is craving for. ;)'

That is exactly what the UK is trying to do, it is giving countries a reason not to support Serbia because the poor dear Kosovars are supposedly without voice and reputation and are being left out of Serbias big bad Wolf legal equation.

You and I may agree that this frustration ludicris; Kosovo has no shortatge of Western agents who will defend their decision to illegally recognise Kosovo to the best of their considerable abillities, using resources that Serbia can only dream of.

This UK endeavour is crazy like a fox . The fact that this is a "last minute motion" does not spell out desperation, instead it spells out strategy. Everyone I know uses last minute motions, when last minute motions are the best tool; there is no point in tipping your hand too soon.

The Nato powers are betting that frustrating Serbia's legal defence will either give the UK more time to implement Kosovo's Nato-colinization/Independence or it will cause Serbia to redraft it’s legal argument, and weaken the prospect of it getting past the GA or winning before the Tribunal.

This legal tactic by the enemies of Serbia's Soverignty and righst is the Serbian Government's first real test of its legal prowess.

Tomorrow, once and for all the supposedly western oriented intellectual leadership of Serbia intellectual' " aka The “For a EULux Serbia block” will show if it has any game or not.

The fact that this Government has put all of Serbia’s legal eggs in the ICJ basket is quite disturbing to me.

I doubt Serbian diplomacy will heed my advice, but a
wise Serbian tactic now would be to announce that: Any reasonable person can adduce that Serbia's legal question before the court is perfectly clear, and within Serbia's rights as a Charter member of the United Nations. Colonial powers (colonial powers is a great phrase to illicit Asian, South American and African support) must not be permitted to silence a small nation's application of international law in defence of its very existence.

Serbia could go even farther and say : A denial of natural justice may prompt Serbia to consider other legal avenues not excluding individual lawsuits against those who have damaged Serbia’s sovereignty.

instead of saying anything like this,Team Tadic glad hands, and recieves awards from the western sponsers of the DS and Kosovo independence meanwhile Drug dealing Kosovo Seperatists dance a jig knowing that Serbia's defence is in the hands of a toothless Serbian Government.

How much more precise you want it to be? It’s legal or illegal, very simple.
If ICJs ruling on Serbias initiative is no big deal, and has no binding on its verdict, why so much noise. UK and others are getting nerves. They didn’t thank Serbias resolve was so strong. They though Serbia was going to crumble under their pressure. Soon they will realize Serbia means business. And nobody is above the law. Including UK, USA or K-Albanians. They know recognizing K-Albanians UDI without UNs approval was illegal.

Smart move, but not sure, that motion will go through or not. Kosovo is not in the UN and allowing them to represent their case would from some point of view mean precisely the recognition Kosovo is craving for. ;)

The last minute motions prove:

1) ICJ has certain significance
2) Usually the losing side uses last minute motions. I do not want to celebrate the victory before the battle begun tough. Albanians side is very-very strong and they have some exceptionally smart people at their disposal.

Hello,

Typical. The UK and US know what decision will come back so they are trying everything to have Serbia's initiative in the UN not pass. Serbia doesn't owe anyone any further explanation on why they want their initiative heard in front of the International Court. Time has run out on the Super Powers of the world. This is a stall tactic that the UK is trying to pull off. All of the super powers know that any ruling by the international court is non-binding however, they also know that the International Court will come back with a ruling that the so called declaration of independance that is supported by the US, UK, France, Germany etc. is illegal. This will definitely hurt further recognitions and may allow for the withdrawal of current recognitions.

Let the precise question be asked. Stop interferring U.K., you've done enough of that internationally throughout your entire existence. Regarding the legality of your interferences...thats another question.

"and allowing them to represent their case would from some point of view mean precisely the recognition Kosovo is craving for"

what case is it if only one side does the talking? This isn't like Crimea or whatever, it's about whether Serbs can still rule Albanians based on what they have done to them over the past 97 years.

See "In every stage of these Oppressions We have Petitioned for Redress in the most humble terms: Our repeated Petitions have been answered only by repeated injury. A Prince whose character is thus marked by every act which may define a Tyrant, is unfit to be the ruler of a free people."

Kosova had their autonomy...until Serbs decided to revoke it using propaganda.

Serbs are trying to gloss over and act as if they are the victims.

Pure desparation on the part of the UK technocrats pushed on no doubt by the US - its common knowledge they are the US poodles!!

Maybe the UK officials should submit their own proposal if they feel that way?

What is clear is that they have left it too late to have any sway on Serbia's initiative and are now clutching at straws - The UK govt will not be able to ignore the ICJ judgement even with being non binding it would be far too problematic on the world stage to disregard it and Sawers well and truly know it!!!
One wonders what they told their puppets the Albanian mafiaocracy???

What is this? The UK blatantly breaks international law, yet again, and now they are trying to weasel their way around it.
They must be very upset that most of their former colonies are not cooperating with them in their illegal attempt at land theft.
The way they are behaving lately is a sign of the times - there is nothing 'Great' about Britain any more.

Martin

This is diplomatic double talk trying to muddy the water. The question is whether the declaration of independence was legal or not. It could not be a simpler question. If certain powers wish to say that they recognise Kosovo, even though the process was not lawful, that is their business. These same powers will tell soon be telling Russia it cannot take back the Crimea from Ukraine, even though the vast majority living there are Russians. It is really surprising (but very encouraging) that little Serbia is the one that wants to apply international law while the Western Powers think they are above the detail of the law. Again this is an example of Western governments not representing their electorate. I am sure that 90% of British people would say that if something is not legal, your government has no right to do it in your name.
