Just what do people think a ruling at the ICJ will accomplish?

The ICJ is merely an advisory body to the UN General Assembly.

All the General Assembly can do is table motions before the Security Council.

So, the General Assembly can send the question to the ICJ, the ICJ can come up with a position of the subject, the General Assembly can then table motions before the Security Council and..... then what?

Then nothing. never.

So, while I don't think the ICJ plan is entirely useless, it's close to being so. One shouldn't think that anything concrete will ever come out of it, because it simply wont, and people who think otherwise simple either don't understand the role of the ICJ and/or the UN General Assembly, or they're kidding themselves.

given that there are a lot of Albanians getting serbian documents every day, it is clear that there is not so much trust in those socalled "presidents" in Priština, or these simple criminals with animal-names, like the "snake", who can´t even be sure to have security for his own family in their own house... :)

no, you can dream as much as you like to do... but reality is different, and there won´t be any problems, since the most important thing at all, international law, is on Serbia´s side.

and that feels quite good.

last but not least: don´t you think that it is already quite boring to read those childish threats from you?

The only thing we saw was killings, massacres, expulsion and rapes from this “law obeying country” that has become.
This is the only thing that came from Serbia until 1999.
(blero, 8 September 2008 17:25)

The only thing Americans saw was slavery, killings, massacres, expulsion and rapes from the "law obeying country" called USA and/or CSA during the Civil War.

What relevance does it has TODAY?

You may argue, 1999 was 10 years ago, not like 1861-1865 which was over 140 years ago. I argue, you blame today's Serbian government, one of the most democratic in Europe for things committed by a Montenegrin fascistoid madman (or maybe his wife?).

At one point you have to realize, in order to get peace you have to negotiate with Serbs, not Americans or Russians. What was done on February 17, 2008 did throw back you for an other decade on that process.

Blero,
Let's get the facts straight. Kosovo got all the funds, help and freedoms from Serbia and rest of Yugoslavia for tens of years. What did it provide in return to its Serb citizens. Even rights of Serbs were suppressed thru Tito regime and afterwards in Kosovo and elsewhere.
What did Kosovo provide to the Serbs? It provided killing, extremist guerillas, kidnapping, etc. The Serbs were systematically cleansed, killed and expulsed from Kosovo. How about rights of the Serbs and their children in Kosovo?
- right to live in Kosovo
- right to live in peace and study in their own language
- right not to be expelled or ethnically cleansed by KLA, other Albanian extremists. How it is possible that Serbs were supposedly guilty of many things and yet they got ethnically cleansed and decimated in Kosovo by Albanians there? What kind of state and right Albanians proposing. Well, they have almost achieved ethnically Kosovo filled with Albanians.
The Serbs in Kosovo have every right not to be part of such Kosovo, and Serbia should not recognize and reward ethnic cleansing and taking parts of its territory by force. Serbia is a multiethnic democratic state and has every right it preserves its territory and promotes multiethnic coexistence and autonomy for Kosovo and its citizens within Serbia. The government was offering widest possible autonomy but that was not enough for extremists and separatist who want ethnically clean Kosovo and to form Great Albania. Albanians already have their national state next door and it is called Albania. Kosovo is part of Serbia and should stay so.

"Granted, it’ll have to wait for the bankrupt USA to withdraw from Kosovo first; but it is only a matter of time before the Albanians are left to fend for themselves and to defend themselves. "

Oh, please!! Serbia never had control over Kosova even with 60K Serbian solders in there. Serbia could never control Kosova for 100 years.

You wish 2 millions K-Albanians living there would banish over night because your army it will never step foot on that soil.

It is funny how hard is Serbia advocating about international law since the Kosovo independence.
Where was this level of the respect for international law before?
Or let us leave aside the international law, where was the respect for the basic human rights before?
You know which rights I am referring to:
The right to live for starters;
The right to play without a fear;
The right to be a child when you are 5;
The right to be a teenager when you are a teenager;
The right to a proper burial as opposed to the mass graves;
Should I go on?

The only thing we saw was killings, massacres, expulsion and rapes from this “law obeying country” that has become.
This is the only thing that came from Serbia until 1999.
You say the word “Serbia” to any Kosovo Albanian and the endured suffering and the missing family members come to mind.
And, we never got a “sorry for all of that”.
We never got “we promise to respect your rights from now one”.
We never got “we were wrong but we will try to make things right”.
Even today the only thing we get from this “law obeying country” is obstacles and attempts to destabilise our country (yes, our country).
Now, we talk about international law!
Now you acknowledge that the international law exists!
So, when you cannot kill Albanians as you please anymore and you cannot use the threat of force any more you convert to an international “law obeying” country.
Funny!
Too little too late guys!

You are mistaken. If international law has changed and now allows borders to be changed by force, then Serbia has every chance to regaining Kosovo. Granted, it’ll have to wait for the bankrupt USA to withdraw from Kosovo first; but it is only a matter of time before the Albanians are left to fend for themselves and to defend themselves.

Over the next 20 years, American and British efforts to destroy the UN and the sovereignty of nations will lead to dozens of wars and millions of deaths. Kosovo will not escape this maelstrom.

If this was solely a legal issue Adam Dershowitz would easily win the case on Serbia's behalf.However,the birth of any country has rarely been a legal question as opposed to a political endeavor.Serbia probably has a 50-50 chance of prevailing at the ICJ but even if it does who in the KLA will care?

ben

But reading Vojo Kostunica at Politika it didn't really look very optimistic.

Neither on the fact that you will get the approval form the general assembly of UN and neither on the fact that the ICJ will rule on favour of Serbia.

Moreover, he was worried about the fact that after that Serbia has no other options on her hands...

So... the autumn is approaching and with that the clouds and rains in Serbia...
