On which ground can serbia pretend to sovereignity over kosovo? The will of the albanians to join serbia, after the fall of the ottoman empire? certainly not,so icj will have first to discuss this point and tell to serbians where is serbia after the end of yu.

You bet its legitimate!! once the ICJ ruled in favor of Serbia you have to "withdraw" your recognition of kosovo UDI and encourage a renegotiation of kosovo final status.

It's total failure of democracy and the reasonable thinking.

Denying the right to go to the Court when you have dispute or case/problem.

That's DEMOCRACY & Law and Order per US and some EU members - no question that best fits Albanians afraid of Law and Justice - even having their own corrupted judges. Something smells bad big time there.

Careful Bernie, you don't want to make it too obvious you have plans of influencing/bribing/threatening various members of the ICJ to deliver a ruling to your liking. It's bad enough most of us know the failed attempts at finding dialogue between Serbs and Albanians were the result of US and EU guarantees of independence as early as 2004.

International community (7 out of 8 most powerful countries in the world, 21 out 27 EU countries-Portugal and Greece to join later this year) already have studied the Kosovo’s case for long time and decided to coordinate all efforts to set Kosovo free and to end colonization in the middle of Europe.
They already know that outcome of ICJ because they in coordination of Kosovo’ people and government already have tried all possible solution until come to a decision on February 17, 2008.
Nothing is new for international community on Kosovo’s case that’s why they will not change the position.
What is the good thing that comes from ICJ? It is for government of Serbia to tell its own people that “we tried it but we lost it” legally also as others lost it in the war.

Maybe the ICJ is crooked. The way Kouchner speaks, you could conclude that he is foreshadowing the outcome ruling of the ICJ. Serbia should not trust any nation that is part of the EU recognition team.

Kouchner, when you talk of preserving the territorial integrity of Georgia, and international law, and at the same time you push for the illegal and immoral theft of 15% of another country's territory, you have lost all credibility.
Don't you realize how ridiculous you look? I guess it's a case of 'no morals, no guilt'.

B92 is playing with his words. He clearly told the Serbs you have the right, BUT we also have the right to delay you EU entry. In short he said that ICJ was a mistake, If Serbia wants EU

“They’ve (Serbia) submitted the petition to the UN General Assembly and we will see what the response will be. This does not change our position,” Kouchner noted.

Enough said.

Bye bye EU (for Serbia).

since I do not think that Mr.Kouchner is that stupid, I´d rather say he is deliberately talking nonsense.

but, what is there to expect from a man who served as a proxy in the occupied serbian province of KiM.

his words are just as the threats with sanctions agains Russia - just empty words without real meaning.

Could someone please define what exactly is the 'international community'? This expression appears in almost every sentence here and in many other news, to justify various actions. Example:- '...the international community, via Martti Ahtisaari's plan, had assumed its responsibilities and was applying them.'

Could someone let us know who IS and who IS NOT the international community (in terms of representation) and indicate who exactly has given them the 'assumed' 'responsibilities'?

Because without a clear definition it sounds like a hollow concept.

The legal international community as far as we know is represented in the UN.

“We said that (Serbia) cannot ask Europe to join it and, at the same time, want (Europe) to fully agree with its petition. However, they are entitled to seek this opinion, just like all other countries.”

“They’ve (Serbia) submitted the petition to the UN General Assembly and we will see what the response will be. This does not change our position,” Kouchner noted.

Very well said. No matter the court's ruling, which is uncertain by the way, the position of indepedence will not be changed.
but Serbia has to think, do they want pursue ICJ or Europe?
