So, the Serbian Constitution does not recognize extradition...why were and are Serbians in the Hague Cirkus Tribunal? Why no USA citizen there? Kovacevic, he has in Serbia judges and tribunals, should he be guilty. Can we ask from the Usa extradition of Bill Clinton, Madeleine Albright and a long etc?

Frankie

pre 15 godina

Most of the comments regarding the case seem to be biased.

My understanding is that since Serbia's Constitution doesn't allow for its citzien's extradition then id doesn't have to.

However, its consul acting on behalf of the country has legally implicated it, which means Serbia can and will be held liable.

As for someone who suggested that [the] "consul should be facing [the] harshest penalty" that is a completely Serbian matter.

Lunger

The comments here are so ridiculous and the usual Serbian nonsense. Childish fingerpointing and crude justification of the illegal actions and duplicity of the Serbian consul. Kovačević needs to face justice. He nearly killed someone - and forever ruined their body. It is a serious, aggressive crime - not some accident. If Serbia is going to use their constitution to avoid making the most sane choice, then they need to handle the case in Serbia and provide a trial now. Anyone who sits here and justifies Kovačević's actions and Serbia's illegal actions in smuggling him out because of NATO, Kosovo, 'they hate us', or any other tired, dumb Serbian cliched response is wrong and boring.

It is disturbing to see US acting with «justice»... Two years ago in Romania a drunk US marine killed in Brasov a romanian musician passing at red light and to not be brought to the court the US in a hurry sent him home to bring him in the court of «justice». And justice has been done!!! Not GUILTY! The people from around the world must understand one thing: IF YOU ARE A NON AMERICAN AGAINST AN AMERICAN IN THE COURT ,YOU HAVE NOT ANY CHANCE TO HAVE A FAIR TRIAL! Double standards are OK in US for those little of the world.Hypocrisy of the US has no bounds.Who will bring to justice that adulterer(clinton) for killing civilians in Balkans? Who will bring to justice Bush for destroying Serbia's integrity. You americans are so easy to believe any word spoken by your chiefs... US built in kosovo just after the conflict ended in Balkans a huge military base...do you think they did it for albanians? It is not new i guess for you to see how much US loses the sympathy. You think that anything you do is right ? You'll find more and more hatred in the world as long you have no respect for others even for the least one.

As an American I know that the U.S. would never compromise its own constitution, so while I don’t condone what Kovacevic nor the consulate did, if your constitution says you don’t extradite citizens, then don’t.

This garbage about “bombing masters”, however, is a joke, I cannot imagine you writing that with a straight face. I wish no harm on the Serbian people, and it genuinely hurts me to hear of innocents, whatever nationality, killed during a conflict, but remember that THEY are the victims, not Serbia. Sarajevo, Vukovar, and many more confirm that.

I’m not Muslim, nor Yugoslav, and I generally keep my opinions to myself in matters relating to the war, but even I can see that there is no way Izetbekovic was trying establish some radical Islamist regime in Bosnia, and if you read anything he wrote with even a little objectivity, you would see that, but I will spare any further history lessons.

You can put your self-righteous claims about “bombing masters”, “unfair courts” (yeah I’m sure Serbia is the pinnacle of ethics in government), and “he’ll be tortured if he goes back” (more garbage) where they belong.

So don’t extradite him if its not your way.

He demands that the boy be extradited back to america because the alleged crime was committed in america, but doesn't say that the old nazi that america has been sheltering for 63 years should be extradited to Serbia where the nazi committed his crimes. Typical american propaganda and further incitement for nuclear proliferation. If america does not stand for equal justice around the world and intimidates the world with its nuclear arsenal, then the rest of the world is JUSTIFIED in obtaining nuclear weapons.

Jan Anderson,Sir,
First,it is a supreme hypocrisy from the part of those who shoo in, back home ,their soldiers who committed heinious crimes in Iraq,Afganistan and elsewhere - to give anybody highbrow lectures on the subject of legality.
Second, the U.S.is hostile towards the Serbs. There is a latent anti-Serbian propaganda in the Country ever since they threw those humanitarian bombs and depleated Uranium on us. They need to remind themselves of their' American values' of saving Balkans from wicked Serbs. It is a massage for their Egos.
Third,".. the word of Serbian consular representative can't be trusted". Unbelievable. And this comes from a country whose diplomatic Representative on the highest level has sat with the terrorists plotting, in secret ,against - Serbia. Ever heard of Richard Holbrook, sir?
Finally, Every Serb should know by going to the U.S. he is stepping into a potentially enemy teritory. He will ignore this on his own risk and peril.
It is, nevertheless, the duty of our consular services to rescue our citizens by any ruse possible.

to Bill Warner:

didn´t the US tell us something about "weapons of mass destruction" in Iraq?

was Mr. Powell lying on behalft of you, Mr. Warren? or on behalf of the US of A?

and the consequences were not that a student ends up in the hospital after starting attacking a weaker person and getting the the inadequate answer by a stronger one...

but the consequences were over a million of death Iraqi´s and over four thousand dead US-servicemen.

Bill, you should better think, before you start posting further nonsense-comments.

the bottom-line is:
the consul guaranteed for the boy, and the boy tricked them.

now that he is in Serbia, it´s just bad luck for the US. I would not extradite him, since the constitution doesn´t allow it.
end of discussion.

let´s hope the stupid student does not look for more bar-fights if he gets well again.

It's not a six foot tall, beating up the 'poor' five foot eight boy".

"Mr. Miladin Kovačević is accused of brutally attacking Bryan Steinhauer, a student who is less than half of his size. This was not just an ordinary bar fight. "
I agree with you that Mr. Munter already declared that "this was not oridinary bar fight" is disturbing. He should leave that to the court. To the US court that is. Crime was commited there.

Sreten

pre 15 godina

This one could be a legal mess. Serbia cannot legaly extradite its citizen. On the other hand consul signed bail papers that Kovacevic will remain in the States to face trial.
Consul should be facing harshest penalty.
Kovacevic should probably be extradited by special decree of the government.
After all alleged crime was commited in the US, trial should be there too.
And vice versa, WW2 Nazi should be extradited to Serbia to face trial for crimes commited there.

Jan Andersen, DK

pre 15 godina

Peter RV - so the next time a Serbian citizen is charged in an US court, and ask to be set free on bail, what do you think the judge will answer?

He/she will know that the word of the Serbian consular representative can not be trusted, and probably will allow the defendant to flee to Serbia.

And what will the situation in other countries be? Is this behaviour serving Serbia and its citizens best interests?

ivan

pre 15 godina

This does not end with the consulate. The vice consul was instructed by Jeremic to issue an emergency passport. Everyone knows this. When will the Foreign Minister have to answer for his actions?

Peter RV

pre 15 godina

(Censor: you have allowed Jan Anderson to challange me so permit my full answer- even though you might hate it)

"Was it right for the Serbian representative to sign a document in a US court, promising that the accused would show up at the trial, and then ignore that promise?" asks Jan Anderson.

The answer is YES! The Serbian representative evaluated perfectly the situation : The sentence of "guilty as charged" was already pronounced by the U.S. officials and the Media,so that Kovacevic wouldn't stand a prayer of a chance to defend himself. The American Justice works like Alice Wonderland's Queen of Hearts- 'first the sentence and then the trial'.
American Courts regularly confirm the prejudices created by the Media. Munter's talking of " the six foot tall, beating up the 'poor' five foot eight boy" tells it all.
I reiterate : Kovacevic will be an utter fool to return voluntarily the the kanguroo court in the U.S., although our Government will be perfectly capable to persuade him that it is patriotic to do so.

Serbian Courts are perfectly adequate to treat the brawls among youngsters without creating an international case out of it.
Besides, there is absolutely no guarantee this boy won't be tortured if returned to the U.S. Has nobody read the latest legislature (FISA)passed through the Congress ?

Jan Andersen, DK

pre 15 godina

A question for Peter RV and Jovan:

Was it right for the Serbian representative to sign a document in a US court, promising that the accused would show up at the trial, and then ignore that promise?

If you believe the Serbian representative acted correctly, how do you justify breaking such a promise? Because the US courts are unfair? Because the US and Nato did something wrong in the past, then it is okay to deceive the US now?

Ataman

Mr. Kovacevic has to stand trial in Serbia. Period. After living 15 years in the U.S. and seeing a few cases I absolutely agree with Peter. Serbia is fully capable of punishing Mr. Kovacevic if he is guilty.

wow, ...an US-american official is daring to speak about "honor"?

where was your honor when you bombed a european country from 18.000 feet?

when you bombed hospitals and schools and afterwards simply said it were "collateral damages"?

by the way:

the US of A should stop breaking international law by supporting the illegal stillborn albanian puppet-entity, that would be

" the best for the USA, that would be the best for american honor, that would be the best for justice and for our bilateral relations."

with statements like this it is really emberassing to see the serbian flag beside the "star spangled banner".
