Dodik: RS to sue Dutch government, UN

The Republic of Srpska (RS) PM Milorad Dodik said a lawsuit would be filed against the United Nations and the Dutch government.

I am yet to see a single mass grave of the Bosnjak attrocities around Srebrenica. I remember a Bratunac onslaught which left 200 Bosnian Serb civilians dead but nothing in the thousands.Please show some evidence. To the person saying Banja Luka is the same as Belgrade, I could say Novi Pazar is the same as Sarajevo.

The raids were scorched earth policy with even the livestock being stolen or systematically slaughtered. The waste of food and food sources by the Muslims shows it wasn't (only) about them procuring food by laying waste to Serb farms and industry (cattle raising) so that they couldn't survive there.

Furthermore there is documentation evidence and photos of those the Muslims killed and mutilated.

The victims were often tortured and dismembered. Often times they were burned to death. There are cases of the brain being taken out of the skull or the heart being ripped out of the chest. I've seen the gory photos with the victims IDENTIFIED.

Additionally there was looting of many non food items and burning of Serb homes, there was destruction of Serbian churches and other buildings.

It was ethnic cleansing and genocide by the Muslims carried out over the years.

The Muslim army did get plenty to eat to support thousands of men and there are no documented cases of starvation.

Serbs occasionally stopped convoys as weapons were smuggled into Srebrenica all the time. As well there were airdrops and helicopters going in and out. The Muslim army, including Naser Oric, would travel to Tuzla on helicopters.

The army and paramilitary often kept civilians from leaving as they were a civilian shield to hide behind after their forays.

There was at one time a food problem after the Muslims had destroyed so many Serb villages surrounding Srebrenica, but the UN stepped in and kept the soldiers well fed and allowed supplies of weapons to come through during its time as a "safe haven".

There is also the question of what, exactly, the RS will sue the Dutch for?

The facts are:

The UN Security Council declared Srebrenica a "safe area" in April 1993. On 13 April 1993, the first group of UNPROFOR troops arrived in Srebrenica. The Dutch battalion of UNPROFOR was stationed in Srebrenica from February 1994 until July 1995, when Army of the Republika Srpska (VRS) troops under the command of Gen. Ratko Mladic overran the UN "safe area" and methodically slaughtered thousands of its Bosniak inhabitants.

"[The] accusation levelled at the Bosniak defenders of Srebrenica is that they provoked the Serb offensive by attacking out of that safe area. Even though this accusation is often repeated by international sources, there is no credible evidence to support it. Dutchbat personnel on the ground at the time assessed that the few "raids" the Bosniaks mounted out of Srebrenica were of little or no military significance. These raids were often organized in order to gather food, as the Serbs had refused access for humanitarian convoys into the enclave. Even Serb sources approached in the context of this report acknowledged that the Bosniak forces in Srebrenica posed no significant military threat to them. The biggest attack the Bosniaks launched out of Srebrenica during the more than two years during which it was designated a safe area appears to have been the raid on the village of Visnjica, on 26 June 1995, in which several houses were burned, up to four Serbs were killed and approximately 100 sheep were stolen. Dodik and his people are turning into a real joke, balkan style, which means that at core it is not very funny. for an entity built directly on genocide, they have a lot of what we call "chutzah" which loosely translates into "nerve."

the only thing i want to hear from him is when they're tuning over karadzic. period.

and b-92, please stop censoring my posts. we have a right to our opinions too, not just the nationalist extremists.

Mr. Dodik, as usual, is engaged in political theatre rather than making a serious proposal. In his speech, Dodik claims the RS will soon "file a lawsuit against the Dutch government and the UN". But he does not say where he proposes to file this supposed lawsuit.

The International Court of Justice (ICJ) was the court where Bosnia and Herzegovina brought its suit against Serbia and Montenegro. That is because the ICJ is the international court established to judge disputes between states.

The ICJ's founding document, its statute -

specifies that "only states may be parties in cases before the Court." (Article 34)

However, although Mr. Dodik would very much like to pretend otherwise, the Republika Srpska is not in fact a state. Therefore the RS has no access to the ICJ.

Unlike the group of Bosniak women survivors from Srebrenica who are now bringing suit against the government of the Netherlands (in a Dutch national court), the RS is also not a private individual seeking legal compensation for an injury from a state.

In fact, the RS has no legal standing to bring a lawsuit in a Dutch court. The Republika Srpska - as one of the two legal entities that are part of the country of Bosnia and Herzegovina - was formally established by the Dayton agreement. Under the terms of Dayton, the RS is an entity, not a state, and it exists only as part of the internationally recognized state of Bosnia. On the international scene, Bosnia and Herzegovina speaks for all of the country, including the RS.

That is why the RS is not entitled to file a lawsuit in a foreign court, just as the government of Vojvodina would not be entitled to bring a case in a foreign court on its own. In such a hypothetical case, Vojvodina would have to ask the Serbian Foreign Ministry in Belgrade to act on its behalf. Similarly, the RS would have to go through the Bosnian foreign ministry in Sarajevo. It's not going to happen.

Mr. Dodik is not being serious -- he's only making speeches for public consumption.

It's a shame because the Dutch people have always supported us in Kosovo and Bosnia however since the Netherlands is a United States colony they cant speak based on the will of the people.... shame

Dodik I never really appreciated your aggressive policy towards the Serbian Radical Party, or when you gave in to police reforms in Bosnia... but you are an honest politician who is looking for the best interest for the Serbian people in Bosnia.



Banja Luka is just as Serbian as Beograd.. no artificial borders will ever change that
