Croatia wraps up case at ICJ

Croatia has asked the International Court of Justice (ICJ) to decide that it has the jurisdiction to try Croatia’s suit against Serbia for alleged genocide from 1991–1995.

Heh, what a joke.Croatia should be sued by Serbia for ethnically cleansing the Serbs from the Croatian territory.
In 1900, 1/3(33%) of Croatia was populated by the Serbs, in 1945 1/4(25%) was populated with Serbs, in 1991 same numbers as in 1945 and in 2008 there are only 1/20 (5%) Serbs in Croatia.

I'm trying to figure out what point Croatia is trying to make by pursuing a case against Serbia which Bosnia has already proven a waste of time. Could this simply be a distraction?.. an attempt to get the Croatian people to think about something else while the politicians are killing shipyards, selling off assets, and nailing the country to EU cross? In the meantime, will another court decision similar to the Bosnia case reinforce the notion that the righteous EU is not really against Serbia after dismembering it? In other words, is this organized and orchestrated by politicos on both sides, each with an interest in distracting their populations while they deceive them into the greedy hands of France, Germany, Italy and others?

Listen folks, nobody needs a court to tell the world that the Serbian Communists, as well as their allies across the former Yugoslavia, started the war. As far as reparations... everyone knows that even if a court is going to order some reparations, it'll probably go into the hands of those people, in Serbia and Croatia, that are pushing those nations into the EU.

I'm just wondering if there isn't something else going on behind the scenes. Aren't you?

Please keep in mind that there are two separate international courts in The Hague:

* The International Criminal Tribunal for the former Yugoslavia - ICTY (MKSJ in Serbian)

and

* The International Court of Justice - ICJ (Međunarodni sud pravde).

The ICTY is a war crimes court and it has the power to try only individuals, not states. This ad hoc (temporary) court was created in 1993 by a unanimous vote of the UN Security Council, for the purpose of bringing to justice persons accused of serious violations of international humanitarian law in the wars of the 1990s in the former Yugoslavia.

The ICTY has no jurisdiction to prosecute any persons for crimes that were committed before the 1990s, or outside of the former Yugoslav countries.

The other court, the ICJ, was established in 1945 as the highest judicial organ of the newly-created United Nations.

The ICJ does not judge any criminal cases against individuals, nor does it have the jurisdiction to deal with war crimes or aggression.

The ICJ is a court created to decide cases brought before it by UN member states -- to settle legal disputes between countries.

As a result, ICJ cases deal with matters such as border disputes, territorial or financial claims, or alleged violations of treaty obligations by a UN member state.

The ICJ cases brought against Serbia by Bosnia-Herzegovina and by Croatia are also connected with a treaty -- the 1948 Convention on the Prevention and Punishment of the Crime of Genocide. UN member states that have signed and ratified the Genocide Convention are bound by the legal obligation to prevent and punish genocide. The cases brought before the ICJ by Bosnia and by Croatia claim that Serbia violated its treaty obligations with respect to the Genocide Convention.

But neither the ICJ nor the ICTY has legal jurisdiction to deal with any crimes that were committed during World War II, which ended before these courts (or even the United Nations) were created.

You want Serbs to apologize to Croats while at the same time your politicans and youth celbrate Fascism and your Nazi Past in concerts, chanting "kill the Serbs."

I think you over estimate your chances for such an apology, certainly never from this SERB!

Prove it. Just as the numbers are being revised in Bosnia from 200,000 dead to 20,000 on all sides, just as the myth of 50,000 women raped in Bosnia was exposed, just as the lies of US secretary Reuben were exposed that genocide was occurring in Kosovo and that entire soccer fields were being used as cemeteries, so to, the myth that ethnic cleansing took place in Croatia by Serbia is being exposed. This is all propaganda from Serbia's enemies. We Serbs new that we were defending the Krajina Serbs from fascism and discrimination as an analysis of Tudjman's policies will reveal.

At last some long due drive for justice. How is it possible to move on to good neighborly relations if responsibilities about crimes is not taken.

While one can be fully assured that all sides involved in conflict have commited crimes against humanity, a distinction should be made of the scale and the means of the crimes commited. It is not the same as killing a handful as killing hundreds or thousands. Most importantly, actions should be taken against those that had more means and weapons to do it and especially those that employed large institution to carry out these crimes.


Serbs will be kidding themselves if they think that they can get away without a moral accounting for what they did as a society (remember, there was no rallies in Belgrade or elsewere against ethnic clensing commited by serb forces and paramilitaries).
One must at least acknowledge what they have done. However, from judging of what the serb nation has not done yet, I will be suprised if they take a moral stance against war crimes commited by their soldiers. And while this might not be a priority for serbs today, be asured that it will prove to be costly towards relations with their neighbors. After all, TIB--This is Balkans and one plus one is often anything else but two. Remember, myths do not drop from the sky. They are human creations. It is only that in the Balkans they are BELEIVED. It takes people to beleive them and to liven them. As a result, couple hundred of years later, there was a great drive to create Great Serbia, a drive which wanted to enslave forever Croats,Slovenians, Bosnians and Albanians. How interesting that they took such a more favoring stance towards Macedonian and MonteNegrins who are by default Orthodox. Sebs fought Catholics and Muslims but not Orthodox nations. Isn't this a religious war?

I challenge Serbian intellectuals and those of a higher conscience to answer as to why Serbia did nothing while the ethnic clensing took place.
