“OR a declaration from the UN Secretary General or the Security Council president.”

http://www.un.org/sc/presidency.asp

Which is currently the UK, in June it’ll be the US. Sounds like they are planning an end run around Ban to me.

Kate, I totally agree with you but since when did the US respect internatinal law?

Iraq invasion was not approved by the Security Council and yet America managed to get their possie to go after them. They declared war on a sovereign country without UN approval.

Perhaps they will be a bit more cautious here as this is after all Europe and America's mates might not dare declare war on one of their own countries, especially since Serbia has the backing of Russia, China and Greece.

I only hope that reason will prevail and if there is no change to Res 1244 the legal way they will not push their own version ilegally.

Of course Russia and Serbia want to frustrate the Kosova's Albanians in insisting on UMNIK to continue its role for at least one decade until Serbia gets in EU and block the entry of Kosova in EU. I know this is just an elusion!

You didn't see independence either did you?

Well, I still don't see independence, so what's your point?

Tell me, why hasn't the EU deployed its force already? Why are the Albanians following the Ahtisaari plan when it was not approved by the UN? How on earth do you expect to make progress when Russia, China and Serbia are firmly against independence?

What has changed since the IUDI and what will change after the illegal constitution?

The only thing that is changing, my dear Albanian friends, is that Serbia continues to strengthen ties with its loyal citizens and that includes the Goranis.

Mr. Ban Ki Moon must continue to uphold the UN Charter and not to bow to the wishes of George W. Bush / Gordon Brown & Javier Solana. All nations are watching you very closely.

"Therefore, unless there is a mutual agreement struck with Serbia over its deployment, I can't see how EULEX can be deployed at all"

Mr. Ban Ki Moon Please make sure that any change proposal will have to be approved by the UNSC and the 5 permanent members. kindly continue to serve for the greater interest of the UN and not to a lone superpower who pratically doing a lot of mess right now. see what they have done in iraq and afganistan. Serbia is a UN member state and it's territories including kosovo had to be treat with respect.

This idea of Eulex starting in the fall will be moved further to Winter and so on and so on. One need only look at the case of East TImor and its independence from Indonesia. It was Indonesia that allowed a UN sanctioned referendum and it was Indonesia that permitted the deployment of a UN peace-keeping force to supervise the indepenence process in East TImor. What's the difference my KLA friends may ask. The difference is that EULEX Cannot deploy without Serbian and UN say-so. I mean it can deploy but it cannot be efficient and will not determine the outcome of Kosovo. It is merely going to waste time and money and infuriate the K-A population which they will pay in kind with more violence direced at internationals. The key is look at the East Timor scenario. East Timor wasn't even a part of Indonesia since it was invaded and occupied in 1975, and it was still the Indonesians that allowed independence to happen. Kosovo was, is and will be a part of Serbia so it will never agree like indonesia to allow independence. My K-A friends get prepared for reality.

Kate

"The EULEX mission was launched by the EU in accordance with the plan of UN Special Envoy Martti Ahtisaari, although it is opposed by Russia, a permanent member of the UN Security Council that can veto such decisions, and Serbia."

So they are holding off until after the UN General Assembly meeting, and yet even if they are recognised by 97 states they will STILL have to get approval from the UN Security Council.

Therefore, unless there is a mutual agreement struck with Serbia over its deployment, I can't see how EULEX can be deployed at all.

Also, the A Plan was rejected - so who exactly can implement a plan which has not been approved by the UN when the province remains, as confirmed by the UN, a province of Serbia and under Resolution 1244?

Why don't they deploy to Italy a beloved member of Brussels. Clean up the garbage in Italy literally and figuratively like in Naples ,corruption ,politicians cozying up to the Mafia. They would have 100s of years of work in Italy O wait a minute it might be illegal to do that to one of its members then again it never has stopped them before. For Brussels legal ,illegal is just mincing of words they would fit well in the Mafia culture in Italy and found a home deserving of them and of their hypocritical expertise.

It proves that the US and EU will not always gets what it wants because Russia, China & majority of the countries still supports international law and order. EULEX & Martti Ahtisaari plan have no mandate from the UNSC and therefore ILLEGAL.
