EULEX: Solution via dialogue

Head of the EULEX mission to Kosovo Yves de Kermabon says he is ready to talk to Kosovo Serb representatives elected at the May 11 local elections.

On the matter of the war that was - NATO had no mandate for conquest and neither do they now. It was a 'humanitarian' intervention (probably with some justification) to stop possible repeats of the kinds of actions that had occurred in Bosnia. However, it was also an intervention into a conflict that was generated by the ethnic cleansing of Serbs by Albanians.

Democratic Serbia is still the owner of the province of Kosovo and is only hampered in its actions while 1244 is in force.

If the UN allow the EU take over administration in support of the UDI then 1244 is effectively at an end. Serbia can then move its administration into the province quite legally.

You are trying to ignore an extremely important fact that there was a WAR IN KOSOVA, and what the Serbian state did there!!!!

I am shocked by the love expressed in these comments towards UNMIK. I thought Serbs didn’t like UNMIK and resolution 1244 before the declaration of independence by Kosovo. To my recollection the K-Serbs have been boycotting most of the UNMIK organized local election and UNMIK was forced to appoint local Serbian officials. So I don’t understand this, you can’t have it both way. I guess when Kosovo gov’t will ask EULEX to leave few years from now Serbs are going to express the same love that they have for UNMIK towards EULEX.
Either way, I agree with Yves that only with dialogue we can resolve any issues. I hope the K-serbs will start looking up for their interests instead of looking up to the interests of politicians in Belgrade who are using them for their political gains.

I just shivered reading the above. Maybe they'll teach us also how to get rid of these useless parties and vote always 70% for only one? (Before it was 99,99%, but now 67% is enough).

Russia has already taught how to deal with separatism: take a trip to the pacified Chechnya (which today matches fully the standards of intl law, beeing the solution accepted from the vast majority of the today living Chechens).

Kate, Kosovo's partition is inevitable, if not territorial, then for certain administratively. By actually calling for negotiations to open with the Serb leaders elected through last week's elections, EULEX has bascially pulled a 180 and no recognizes the legality, if not the reality, of the Belgrade-backed elections as well as the dual government system that exists on the ground.

I have no doubt in my mind that a Bosnia-like solution is now destined for Kosovo, as it could very well be agreed upon by a Tadic-led government. EULEX and UNMIK understand the limits of their authority north of the Ibar, and even Thaci is smart enough to know where to draw the line. Personally, I can't see any other solution to Kosovo's perennial instability.

The whole thing's a joke. There is no independence. It was a move which has backfired and led to no more than talk and even more whacking great salaries (good grief - give it to the people who need it for food and other urgent provisions!).

Now it's just a case of figuring out how to climb out of the hole and create some face-saving measures.

Back to the table to find a way to avoid violence and further disruption. Time for international law to get back on track.

It is very clear that UNMIK remains and all that INLEX (Lawless) will be is a go between for the now illegal self governing ethnic Albanians within Serbia's province and UNMIK - hardly a receipe for success given the last 9 years economic development under UNMIK and now with this extra layer of EUcrats as a go between !

I wonder what will beocme of the aid donor gathering supposedly planned in mid-June for this illegal self representing non-entity? The illegal 'self declared dependence ethnic Albanians in Serbia's UN recognised province have little left if at all anything given the current credit crunch fiasco in western economies - hardly surprising that there is litle talk of a donor conference since before the illegal declaration of Dependence. In February there was confirmation;

""I can confirm that the European Commission together with the World Bank is preparing a donors' conference, most probably for June," Commission spokeswoman Krisztina Nagy said."

- yet 2 weeks before June not even the slightest talk - no doubt this has been shelved too?!

You cannot avoid the presence of EULEX from being political, M. de Kermabon.

"De Kermabon stated that the basis for the EULEX mission in Kosovo was the decision of all 27 EU countries to approve that mission, as well as Security Council Resolution 1244."

Actually that is incorrect. The EU may have approved the mission's existence, but only the UNSC can approve its deployment with the agreement of Serbia. And you certainly aren't acting within the confines of Res. 1244.

Under Resolution 1244 Kosovo remains a sovereign part of Serbia and the province is being administered by the UN.

Unless the EU are prepared to recognise this fact and act accordingly (which in reality means getting both parties back to the table and finding a mutually acceptable solution) then nothing can move forward as far as EULEX is concerned.

The outcome will be a high level of autonomy or some sort of partition (if agreed upon).

This is not just about Serbia - it is about allowing a group of nations led by the US to decide that independence can be granted on someone else's sovereign territory. A declaration of independence by a minority group (even though they are a majority within the province) cannot be the basis for any new nation gaining sovereignty.

I hope that the Russians don't just let this drop and continue to push for adherance to international law, for the sake of all Europeans.
