Date set for Croatian genocide suit vs. Serbia

The preliminary hearing in Croatia’s lawsuit against Serbia for alleged genocide will take place at the International Court of Justice in late May.

the fact that serbs insist on serbia suing croatia is just a coninuation of greater serbia idea. Croatia didnt fire a single bullet inside Serbia as far as anyone is aware. But many croats were expelled from Vojvodina.

As for Krajina, u cant sue someone for ethnic cleanisng when ur own RSK government trained its people for evacuation 3 years before Oluja and began evacuations prior to Oluja. this is on paper and testified to by RSK Prime minister Babic. Indesputable but it is conveniantly ignored.

Someone on here mentioned census in Krajina....good let that come out...then we can look at census of Croatians in Krajina before 1990 and in 1995. Lots of serbs forget that entire Krajina was serb occupied whilst serbs only had majority in eastern part of Krajina.

As for ww2...why not....then croatia can look to serbia for compensaitions from Bleiburg massacre. Not to mention various Cetnik crimes in slavonia in particular. it shake their poetic view of themselves.

Genocide law suit may not and probably wont be found in favour of croatia. genocide is difficult to prove....but judges will comment when it comes to the verdict and that may be enough.

The detailed census result shows it was Serbs who were genocided out from Croatia, not Croats.

The majority of Croats killed in the war were military and police. In a few cases the Croat police were killed by other Croats as a pretext for blitzkriegs against Serb villages.

Croats admitted some of the killing of their own police before one of the major operations - either Operation Flash (Spring 1995) or Operation Storm (August 1995).

Croat police started attacking Serbs and their property at the very start of the war.

I do think Serbs can sue Croats for property and land theft because the Jews are still going after Germans and their aiders.

The property of hundreds of thousands of Serbs has been taken by Croatia and Serbs should sue to get that back.

The fact is that the NDH is not related to the current Croatian nation -- in fact, Croatia was heir to the former Socialist Croatia of Yugoslavia.

And during the Serbo-Croatian War of 1991-1995, most of the people killed were Croatians and most the perpetrators of the killings were Belgrade-aligned forces.

Here we go again, Serbia questioning the legitimacy of the ICJ even though its jurisdiction has even been confirmed in cases concerning Serbia!!!
Serbia will probably be found guilty of perpetrating genocide, under the Genocide Convention, because, unlike Bosnia, the Yugoslav army under Serbia's direct control perpetrated such acts.

This will be interesting. Kosovo might follow suit.

Participants of the Fourth International Conference on Jasenovac, have already adopted a Declaration requesting a lawsuit to be brought against the state of Croatia for genocide committed over Serbs, Jews and Gypsies during the Second World War in March last year.

The members of conference included not only Serbs, but Roma and Jews, including Arie Livne who participated in the conference.
(he is a representative of the World Jewish Congress).

And what exactly do you mean by ''you did it too''.

Serbs made no genocide over Croatians. That is an insult to say, firstly, secondly using the word 'genocide' so irresponsibly insults, spits an undermines millions of those who died in WWII, Indian Genocide by Arabs, Native American Genocide by Europeans, Armenian Genocide by Turks, the constant one going on in Sudan at present and others.

An it is called a counter lawsuit. Croatian government is opportunist and greedy, hence the timing.

Learn some facts before you blindly post!

The Republic of Croatia is not the successor state to NDH; therefore it is not responsibile for any crimes committed by that state.

Second, any alleged crimes during Oluja were committed on the territory of the Republic of Croatia - I don't remember any invastion of the Federal Republic of Yugoslavia.

I don't know all the merits of Croatia suing Serbia but they are certainly stronger than any case against Croatia by Serbia.

Just like one Serb said during the wars of the 90's, 'Now I know what it feels like to be a Jew, and to be called a Nazi'.
Croatia to sue Serbs of genocide?? Please. Croatia was never punished for the genocide they commited during WWII, a genocide so gruesome, so sick, that they even made German SS officers sick. This is well documented.
Instead, Tito awarded 'his Croatia', with Istria, Dalmatia, and never gave Krajina any kind of autonomy the way he did to Kosovo and Vojvodina. The naive Serb partisans let him do it in the name of 'brotherhood and unity'. Furthermore, Croatia never apologized or faced any kind of punishment the way Germany did. Then we have pathetic politicians like Tadic actually apologizing to Croatia! Apologizing for what? For getting ethnically cleansed for the second time in the same century?? Not in my name!
Today, they hold Ustashe concerts with 60,000 screaming fans, and cowboy George and Eurocrats visit them and hail them as some kind of 'success'. There is no more morality in the world today, that is very obvious.
Croatia, as well as Clinton, Albright, Holbrooke and compay, all need to be charged for 1995 cleansing of all of Krajina. THAT is a war crime, and we all know who planned, executed it, and made it possible. This ridiculous law suit is meant for the masses to take the focus off of the truth, and make the bad guys look like the good guys, and vice versa.
The propoganda war against the Serbs is in full swing, and we need to be strong and fight back with the truth. The truth is on our side, not theirs.

Easy, just blame the victim!

At one time I believed that Croatians and Serbs were basically the same people, one Catholic and one Orthodox. Clearly the division is much deeper.

I am glad that Croatia is independent, never should two peoples that are so far apart in character and deeds live together as one.

Zagreb wants the International Court of Justice to find Serbia guilty of contravening the Convention on Genocide, and order it to pay Croatia damages to be determined by the Court.
This is not problem at all for Serbia. The damages can be paid with Russian money from Serbian Oil Industry sale.

As someone who's ancestors herald from Krajina whose relative were slaughetered by the ustache in WWII and the remainder ethnically cleansed by operation storm, I can only hope that the Croats are exposed for what they are !

Serbia cannot sue Croatia before the International Court of Justice (ICJ) for genocide committed by the Croatian fascist regime during World War II.

The ICJ was established after the end of World War II, as the highest judicial body of the newly-created United Nations. The ICJ is not a criminal court; it was created to adjudicate disputes between UN member states; the ICJ has no retroactive jurisdiction and cannot judge events that predate its creation. The Convention on the Prevention and Punishment of the Crime of Genocide was adopted in 1948 and took effect in 1951; it is also not retroactive.

Also keep in mind that pointing a fingar at the other side and charging: "et tu quoque" (you did it, too!) is not accepted as a defense in any court of law. It's a mode of argument fit only for school-yard fights, and is not very convincing even there.

So, if Croatia doesn't want to get sued for the 200.000 Serb refugees from Krajina, she better step down now.
