"Samardžić proposal could be basis for talks"

Larry Rossin says that Slobodan Samardžić’s proposal could be the basis for talks between Belgrade and UNMIK.

Here is a rough translation of the article in question:

Agreement concerning a united implementation of UN Resolution 1244, which Minister for KiM Slobodan Samaradzic presented to UNMIK last week, and reached the United Nations in New York. Proposal of agreement drawn up in collaboration with the Ministry of External Affairs and the Ministry for KiM and part of the Action Plan which was adopted by the Serbian Government. The formal title of the document is “Agreement with UNMIK and the Republic of Serbia for a United Agreement of Resolution UNSC 1244 after the Illegal Declaration of Independence by Foreign Temporary Institutions of Kosovo.” The primary regulations for full agreement are:

Confirmation of the valid UNSC Resolution 1244 and the certainty that this resolution is successfully implemented only in joint effort with UNMIK and the Republic of Serbia.

Confirmation of the dedication to acknowledge all preceding agreements between UNMIK and the Republic of Serbia, including agreements between UNMIK and Yugoslavia, of which Serbia is the legal heir.

Recognition of the Office of the Ministry of KiM as heir to the Kosovo Coordination Center. The Office is formed with the goal of assisting the administration of aid programs for the development of Serbs in Kosovo, as well as in collaboration with UNMIK and KFOR.

UNMIK and the Republic of Serbia agree to intensify collaboration in the areas of police, judiciary, customs, transportation, control of the administrative border between Kosovo and Serbia, as well as the preservation of Serbian religious, historical, and cultural heritage.

Serbian police officers will answer to local Serbian authority and serve under the command of UNMIK police.

Kosovo Serbs have the right to handle their own judicial questions, while international judges under UNMIK answer cases which include members of other ethnic groups.

UNMIK and the Republic of Serbia are dedicated to the development of free trade between Kosovo and other parts of Serbia and the prevention of any trade barriers.

If some third party creates any trade barriers, Kosovo Serbs have the right to establish their own customs authority – UNMIK and Serbia are committed to regional autonomy and unfettered movement of people and goods between Kosovo and any part of the Republic of Serbia.

In the case of religious, historical, and cultural heritage, political implementation in these areas will be exercised and supervised in collaboration between UNMIK and the Republic of Serbia, and this power will be shortly established with the aim to be altogether and functional from the beginning of May 2008.

In current situation and temporarily, division of Kosovo is not bad idea for everybody – for Serbia and Albanians in Kosovo. The major thing is to protect and guarantee minority rights everywhere and protect Serbian historic sites and monuments.
Temporarily – because they need to open borders for flow of goods and people and in long run it should be all EU without borders.
That way Serbia will recognize Kosovo, it will be open road for its acceptance to UN, America will keep Bondsteel, NATO will get happy with the first own made state, and also one restrictions off for Serbia to join EU – if they want it desperately. But it will be always something else they will need to do to join EU – probably something everybody knows it’s impossible to achieve-accept.

For Serbia – is it justice? Of course not, but it’s more reality (is destruction of Iraq, or situation in Gaza, NATO humanitarian bombing – justice – no way, but those are rules of the game in today’s world - forget about truth, justice and moral). Kosovo is long gone and lost and whatever you get now peacefully is a gain.

In the long run, Samardzic plan is not feasible for Serbia too because it leaves them with a huge problem. Those territories would eventually be lost together with the Serbian population but the loss would be someone else’s problem by then. So, as I can see, this proposal is just another way out for postponing the loss of Kosova

Well I'm happy to hear it was not outright rejected by the UN. If UNMIK and Belgrade are willing to negotiate, let's see where this goes.

UNMIK’s high officials Larry Rossin and Ruecker should be under investigation for taking violent actions against judicial workers and demonstrators in Northern part of Kosovo since Mr Slobodan Samardzic sent his proposal on March 16 and yet UNMIK did not hesitate to use the force one day after.

Now, some two weeks after Mr Samardzic submitted the proposal from Belgrade, Mr Larry Rossin says there are basis for talks. So, if there were the basis for talks from the very beginning, why then the use of force against civilians at the first place? Could it be that UNMIK intentionally wanted to provoke Serbs and cause higher level violence in order to present Serbs as troublemakers? Sure, there are no doubts that that was their intention. They hoped that Serbs are going to, in best case, leave the province.

One young life is lost and another two are still in critical condition, these are the lives that had to pay the price of the sick ambitioned UNMIK officials. For the time being, there were only scum amongst UNMIK high officials.
