UN chief to EU: Kosovo mission problematic

Ban Ki-moon has today sent an official letter to the EU regarding its mission in Kosovo, B92 has learned.

my friends albanians and serbians, this is the whole of UNSCR 1244 ARTICLE 10 in question>>>Authorizes the Secretary-General, with the assistance of relevant international organizations, to establish an international civil presence in Kosovo in order to provide an interim administration for Kosovo under which the people of Kosovo can enjoy substantial autonomy within the Federal Republic of Yugoslavia, and which will provide transitional administration while establishing and overseeing the development of provisional democratic self-governing institutions to ensure conditions for a peaceful and normal life for all inhabitants of Kosovo; LEGAL ANALYSIS: this resolution was DONE prior to the deployment of the KFOR and UNMIK. The international civilian presence has been approved as the UNMIK in charge of interim administration in Kosovo. There can be no duplication of this civilian presence as it is written in singular terms. Therefore, no other international presence could be deployed to take care of interim administration unless this resoultion is replealed. ENTIENDES SENIORES???

"problematic" sounds too diplomatic for my taste. In other words lets solve this problem or package it in such a way that we can give you the go-ahead. Perhaps you haven't seen the writing on the wall, but the US can do just whatever they want. They bombed Yugoslavia illegally without a UN resolution. Do you really think they care what Mr Moon says. As for Russia, hot air and a complimentary oil company to boot.

Only thing permanent in this world is change, everything changes from time to time, maybe its time for UN and international law to change, why not? Kosovo is a great story for everybody who understands the freedom and democracy. People who fear Kosovo fear democracy, and we know who fears democracy. UN was there when decleration of independence happened they didn't do anything about it, they were silent and that means that they agreed with what's going. We all know is not the UN who keep the balance in the world, it has never been. UN is not such a great story,they were in Srebrenica, they have been in Africa forever, if it wasn't for the U.S.A half of the people who live today in Kosovo and Ballkans would be dead, and since when you started to be called in international law, if there were international law, Serbian politics and their followers should have been punished long time ago, and guess what? if you think that UN is going to change the U.S.A and EU policy about Kosovo you are not just wrong because you know you have been wrong for a long time now, but you are super naive. KOSOVO is a triumph of democracy against socialkomunisem.

1244 is still valid: so Kosovo cannot become independent. The EU members should get out of Kosovo now!

Why the Russian federation don't invite it self or the commonwealth members of former Soviet Union organization a lot of them are in Europe with the so called EU's saying the European perspective they like to bantee around. Like the EU self invited them selfs the more the better. OF course EU will protest veamentely because they think they are the only so called European view and pretend they have the self appointed right to tell every one what will happen in all of Europe. Past their gated elites borders and every one has to listen to them and follow hypocritical leadership because they are self appointed morons.

I could not agree with you more. The only thing that I am afraid of is the fact that Mr Ban Ki-moon is a South Korean diplomat/bureacrat and it is quite well-know that the US has a lot of influence in that country and this may be the moment the US will request a favor to compensate for the fact that the US supported the nomination of Mr Ban Ki-moon and actively lobbied to support him. To me "problematic" sounds too diplomatic for my taste. Even though he has to keep a straight face and remain neutral he should use stronger terms in case he is uncomfortable with the whole situation. The US has shown its disregard of the UN many times in recent years and a common phrase like "Get US out of the UN" says it all. If the EU thinks it can put itself above the UN either one of them will technically cease to exist. I hope that the EU will be wise and decide to become more creative and start to behave more like the cradle of democracy it is claiming to be. To be continued.

as it claims it is working under 1244,

as 1244 says they are working within FRY,

If the EU sends a mission it is implicitly rejecting the UDI !!!!

Well... the failure to bring EU mission in Kosovo will have negative consequences for serbia as well. Since UNMIK mandate has came to an end, there will be no international body to monitor the government of Kosovo. So the serbs in Kosovo want have the ombrella of international community leaving room for Albanians to manage their powers without interferation. Don;t forget Kosovo is an independent country and if UNMIK leaves... there is no possibility that serbia come to exercise authority. EUREX or INLEX or LINUX (a very futuristic computer program)is for the better of serbs living in the independent Kosova, or what is more important for the preservation of serb monuments which serbia is more concerned rather than with the poor minority living in Kosovo. Interpretation about baroso statements are meaningless. There is no turning back folks. PEACE

The current state of affairs is a product of a concerted, single-minded, bipartisan American effort to turn Serbs into an enemy as the U.S. tries to make friends of its enemies in the region, always at Serbian expense. Paragraph 10 refers to the establishment of UNMIK. It empowers the Secretary-General to "establish an international civil presence in Kosovo in order to provide an interim administration for Kosovo under which the people of Kosovo can enjoy substantial autonomy within the Federal Republic of Yugoslavia."

EULEX was established by the EU, not the UN Secretary-General. Secondly, it now appears that the Secretary-General is warning the EU that EULEX is "problematic" because it is being opposed by members of the UN Security Council.

Just wanted point out beyond the irony that the EU chose LEX (latin for Law) when it is without Legal basis and is thus INLEX (Lawless) the ultimate irony is that they choose Peter Thief (fieth) to head it.

Indeed it is now very clear that the EU mission is very much INLEX (Latin for Lawless) - no doubt this will be being made very clear to my UK member of parliment - this is going beyond just illegality it is now becoming a farce of the highest degree - but then hardly surprising when the EU 'few' have deceived themselves that they have legal basis!!!

I think this can also be read to say that only the interim arrangement need preserve the territorial space of Yugoslavia.

I wonder which clown they are going to send and use to do some damage control (please no Rehn and Solana). I believe that this puts the EU at a cross road. You ignore everything and everybody and risk loosing lots of (maybe all) credibility and a high probability that this will backfire sooner than later or you wake up, realize your mistakes and start working together according to certain rules and take the interests of all parties involved and Europe (and not the US) into account and make them your top priority. The choice is clear and so are the consequences. And please remember that we told you so.

OF course EU will protest veamentely because they think they are the only so called European view and pretend they have the self appointed right to tell every one what will happen in all of Europe. Past their gated elites borders and every one has to listen to them and follow hypocritical leadership because they are self appointed morons.

I could not agree with you more. The only thing that I am afraid of is the fact that Mr Ban Ki-moon is a South Korean diplomat/bureacrat and it is quite well-know that the US has a lot of influence in that country and this may be the moment the US will request a favor to compensate for the fact that the US supported the nomination of Mr Ban Ki-moon and actively lobbied to support him. To me "problematic" sounds too diplomatic for my taste. Even though he has to keep a straight face and remain neutral he should use stronger terms in case he is uncomfortable with the whole situation. The US has shown its disregard of the UN many times in recent years and a common phrase like "Get US out of the UN" says it all. If the EU thinks it can put itself above the UN either one of them will technically cease to exist. I hope that the EU will be wise and decide to become more creative and start to behave more like the cradle of democracy it is claiming to be. To be continued.

as the EU has not recognised the UDI,

as it claims it is working under 1244,

as 1244 says they are working within FRY,

If the EU sends a mission it is implicitly rejecting the UDI !!!!

Please aks YOUR government to protest at the UN against this breach of international law.

1244 is still valid: so Kosovo cannot become independent. The EU members should get out of Kosovo now!

"problematic" sounds too diplomatic for my taste. In other words lets solve this problem or package it in such a way that we can give you the go-ahead. Perhaps you haven't seen the writing on the wall, but the US can do just whatever they want. They bombed Yugoslavia illegally without a UN resolution. Do you really think they care what Mr Moon says. As for Russia, hot air and a complimentary oil company to boot.

my friends albanians and serbians, this is the whole of UNSCR 1244 ARTICLE 10 in question>>>Authorizes the Secretary-General, with the assistance of relevant international organizations, to establish an international civil presence in Kosovo in order to provide an interim administration for Kosovo under which the people of Kosovo can enjoy substantial autonomy within the Federal Republic of Yugoslavia, and which will provide transitional administration while establishing and overseeing the development of provisional democratic self-governing institutions to ensure conditions for a peaceful and normal life for all inhabitants of Kosovo; LEGAL ANALYSIS: this resolution was DONE prior to the deployment of the KFOR and UNMIK. The international civilian presence has been approved as the UNMIK in charge of interim administration in Kosovo. There can be no duplication of this civilian presence as it is written in singular terms. Therefore, no other international presence could be deployed to take care of interim administration unless this resoultion is replealed. ENTIENDES SENIORES???
