EU sources: There's legal basis for EU mission

EU sources say that Article 10 of Resolution 1244 gives Brussels a legal basis for sending its mission to Kosovo.

"Article 10 "authorizes the secretary-general, with the assistance of relevant international organizations, to establish an international civil presence in Kosovo," which has prompted EU officials to deduce that it will suffice for Ban Ki-moon to call on the Union to send its mission to Kosovo, for it to be legal."

And if Ban does that he can be sure his tenure will not be renewed ... in case anyone here doesn't know, the UN Secretary General must be approved by the UNSC.
At least one UNSG failed to keep his job (Walheim of Austria) when Beijing vetoed his reappointment despite strong support from Europe who was not aware of his Nazi past then.

I very much doubt they have found any legal basis for illegal folly. They can of course pretend and hope no-one takes them to account but given that this is a complete U-turn on what was the case last summer;

- I think they will be challenged immediatly and bring their whole folly in utter disaray! Reminds me of the lies and spin regarding the UK government have a legal basis for invading Iraq and this has lost them enourmous credibility globally and from Brits alike.

"Res 1244 does not say Kosova is part of Serbia. It says it is part of Yuguslavia. Since that entity does not exist, there is nothing that ties Kosova to any other state. Read the resolution then talk."

Serbia or Yugoslavia.... it doesn't matter as Serbia inherited what was Yugoslavia. That includes membership to International organisations, property, debt, etc..

Sure EU put their foot in the door you just cant close it now. Some ones foot may get heart and feelings so the door has to come off its hinges so every Tom and Dick can come in with no problem. Don't you know about the new rules they came up with. Safety first and if you like or not they can still make up a law to make it all legalese sounding send it you in Serbian also in Cyrillic writing. So Serbia can feel warm and fuzzy all over that they care so much about Serbia. They will make it all lawful sounding according to EU technocrats and the new EU way its all for the best they might also mention it to the UN chief good enough that will makes it all legal fore sure now. If the Serbs still don't get it or want to get it or understand they will send the wise lawful Slovenians and the Germans to you and explain the great benefits of the new law. Which of course by all means you can ad it to your own laws. Any ways if you still don't understand they are much bigger and wiser just take their word for it one day fore sure Serbia will get it.

This document also claims that 1244 will remain valid even after a possible unilateral declaration of Kosovo's independence, "since it lists no time limitation, or conditions under which it ceases to become valid."

That's reassuring. We know that 1244 states that Kosovo is an integral part of Serbia so lets see how much more of a mess the US and EU can create.

-I just wonder how they came up with loophole after so many years? This is nothing more but the hot air. The most important thing is that 1244 remains as it is even after so called UDI. The resolution will stay and legally cannot be abolished. The EU is creating the terrible mess and they know it. The EU will just disappear as former YU did and that will be because of the USA's interference. The fact the the EU allows Americans installing missile shield in Europe tells much about the EU's power and integrity.
