Hague "seriously concerned" over Tolimir

The Hague Tribunal expressed "serious concern" over the state of health of one of its indictees, Zdavko Tolimir.

I am an attorney approved as a full member to practice before the Tribunal in the Hague. Interested in Tolimir's case, I reviewed Tolimir's indictment as well as those of his co-defendants. Tolimir's right to a fair trial and due process are more important than ever, given the fact that not a single charge had been filed against Tolimir prior to 2005, and genocide was not added until 2006. From the various idictments it is unclear if the indictments against Tolimir were precipitated by any new evidence, directly pointing to his knowlege and participation. Otherwise, it appears he was indicted merely under a guilt by association theory, given his place in the hierrchy of the former regiem. A right to speedy trial is a universal right of an accused. As the years pass, evidence and witnesses for the defense often evaporate. One should ask why such a delay occured if the prosecution gathered no substantially new evidence between 1995 and 2005. During those years, Tolimir was not a fugitive. As Mladic's aid, why wasn't Tolimir indicted with Mladic in 1995? An accused should recieve all the benifits of being presumed inocent, including health care and access to counsel of choice, until all the evidence is laid out in a court of law.

Like the stories and tales you tell us about the Medak Pocket! You were writing here lately that 100s were killed, and you were not there, and the Canadian soldiers who were there talk of app. 70 Serbs killed during the attack of the Croat Army.

When Bosniaks tell me about what they have witnessed in Bosnia, and what the soldiers have done, and the paramilitaries, if I hear you well, according to you, it's all stories. I wish you could hear them; you would certainly change your mind.

I understand your parti-pris, but at least try to remain objective, and stop also your tales and lies.

We are not talking here about all Serbs; we are talking about Seselj, an ultra-nationalist.

A man like Seselj is well known and cannot be compare, Mathew, to other Serbs, or ordinary Serbs. Sesejl is a paramilitary commander, just as Arkan, just as brutal, and he is guilty by compromission until he proves that he was an honest citizen.

Currently a Kosovo Albanian girl whose family was slated to be deported to Kosovo ran away and is now giving broadcast messages that she's going to commit suicide if she doesn't see her family back in Austria.

You cannot believe "stories" without proof and research.

Who are we to determine what rights this man Tolimir has?
According to Victor (at least on an earlier post) we are not to judge and all are innocent until proven guilty...unless you are a Serb.

I would like Serbs to explain why they consider comments about what the army did during the war, the paramilitaries and local militias, who habe participated in massacres of non-Serb civilians, as anti-Serb propaganda?

When I comment on the Vukovar massacre, I say nothing wrong about the Serbs; I simply accused Serb officers of having failed their ROE (Rules of engagement).

The 300 patients from the hospital, Croat soldiers who had been hospitalised during the war, and even those who went there to hide, were all, according to the Geneva Convention, POW. Then, why were they gunned down and not taken as POW?

Could you explain, please?

I have heard so many stories about horrors of all kinds, about atrocities, and I can assure you that I have no hate nor hatred against ordinary Serbian citizens. I don't know if I have hate for war criminals, I don't know how I would react in front of a man like Tolimir, but I would have a few questions about what he has done. He has rights, it is a fact, but do you think that he deserve them after all he has done and let do? Many victims, and I know many, would say that he deserve nothing, not even the air we share with them... but we will never know because we are not victims. I respect their choices and I will never try to dissuade them from thinking what they think. I have not gone through what they went through.

I am really quite amazed at how Lenards comment has manged to make it into this through b92's rigorous moderating but it speaks for itself.
The many mass graves in RS, ok how can you Mr. Lernard prove he has done anything wrong if the court has not managed to do so and how exactly have you uncovered these many mass graves?
You word speak volumes about the type of media which you entertain yourself with not to mention the fact that b92 is allowing your comment which means it is indirectly sympathising with this anti-serb media.
One would be forgiven for thinking b92 was a Serbian news network.

Don't you want to re-state what you say you do, Victor? You are a psycho educator? OK, if you say so. As for Tolimir, he has rights just like any other citizen in the West. Because some of you Croat allys don't like him, does not mean he should have no care and attention. Carrying that hate for Serbs must be a horrible burden. I am glad that I don't really hate anyone.

As a psycho-educator, I have more concern, and «serious concerns» about the psychological problems of children, women and men whom I have worked with in the passed years. I don't think they will recovered completely of the tragic events they ^passed through.

Tolimir is more cared about than he cared about his victims.
