This case isn't about 'innocent before proven guilty' it's about a technical question as to whether an Australian citizen can be extradited to a foreign country based on allegations of crimes supposedly committed in that foreign country.

There was a similar case in the UK. The high court judge ruled that the Serb would not be extradited as he was unlikely to receive a fair trial in Croatia.

The Hague doesn't believe he has a case to answer to therefore he must not be extradited to a Mickey Mouse courtroom in Croatia where he will be treated as being guilty before he steps up on the stand.

Well done to the Australian Serb community although i believe it won't even pass the higher court. The winners here are the Australian legal teams.

Under the Australian legal system "one is innocent until found or proven guilty".
The concern in Captain Dragan's case is that the trial of a Serbian in a Croatian court may show ethnic bias (a lack of balance in a result).

Australia has a very strong and proud Serbian community, and this really hits home with them, with most Serbian settlers of Australia immigrating as a result of fleeing unbridled Croatian offensives in the Balkans on the Serb populations numerous times in history.

Victor,
You are mistaken. Everyone is innocent until proven guilty. Otherwise I agree that he should stand trial.
Please don't say typical of Serbs. Any wonder there is so much hatred in this world with comments like yours.

This is typical of Serbs. They would do anything to stop on of their to face justice. Captain Dragan is accused of war crimes: let him face justice. If he is not guilty, he will be set free. Why such a contempt of court? He is an alleged war criminal until proven non-guilty.
