Most of the North American press is showing some sort of secession, but have stepped back from actually calling independence.

Has anybody even HEARD Athisaari's proposal yet??

On a side note, I wonder what's going to happen in Republika Srpska next door??

But that's exactly the point Arben Qosja! K-Albanians never did manage to possess North Mitrovica. The K-Serbs are the ones possessing that area of Kosovo!

(23/01/2007, Brussels, DTT-NET.COM)-Top German government officials said unilateral recognition of Kosovo’s independence is not an option, favouring a consensus at the UN Security Council on the future status of the territory.

Ignorant? Gee, I guess that PhD I got is useless. Thanks for enlighteneing me. Oh, by the way you should probably email Hegel and Carl Schmitt since they articulated the concept. Legality, hum you mean like the Geneva convention, remember that one? Or maybe the White Eagles and Milosivic didn't get the memo? "Civilization," as you put it, is barbarous according to the Frankfurt School. Why? Becuase it obejctifies the subject that is human life, as does the law which is fundamentally decisionistic (schmitt) and arbitrary. Justice is another matter and can only be grounded in a transcendental ideal (Kant) which once again is external and beyond Serbia or the EU. It resides in the people (Machiavelli) as immanence=self-detrmination. Boy, you are so bitter. As they say hear in the "civilized" West "it's all good, brother."

billy, the entire world is built upon legality/ rule of law. everything. period. end of sentence. this is the most fundamnetal precept of civilization. you make a very ignorant statement. if legality were not an issue, they would have already done it by now. go back to school!

Sovereignty and independence are based upon international recognition not legalities. International law is not compulsory but rather voluntary. The only reason to invalidate 1244 is to preserve the pyseudo integrity of the UN which Serbia has failed to do. Hence, 1244 is amorphous and ambiguous whereas the 'real politic' of mutual recognition is real and concrete. Of course failed states like Yugoslavia and potentially failed states like serbia need not apply. Put that in your pipe!

Apparently there will be some kind of statehood, even not named "independence", and new resolution be adopted, in order to ruin the 1244, therefore Kosova's people (parliament) to, unilateraly, declare independence (as I said earlier), which will rapidly be recognised by main western countries at first, and by all the other countries in a near future.

I think nothing offends the Russian psyche more than the idea that someone is trying to make a fool out of them. You need Moscow to okay the proposal to invalidate 1244.

Unilateral declaration of independence is a double-edged sword. Pristina must rememeber that just as it can unilaterally declare independence from Belgrade, North Mitrovica can also do likewise and declare itself free of Pristina (not that it was under real control by Pristina from the start anyway). This scenario may well happen, then both sides will trade accusations but no one will go to war over it. De facto partition will occur.

Op, it means independence. As i understood from this article, parties (Contact Group) have achieved an agreement about the text of SC resolution so the last hope of anti independence camp is gone and they have only one possible solution: ACCEPT NEW REALITY!

they want it to declare its own independence (so they can recognize it).... and sidestep the legalities.

however.... that is a very dangerous step to take on their part. it leaves the north of kosovo vulnerable; it sets the stage for a belligerant serbia....and republika srpska can do the ask for the exact same thing. of course, srpska will be denied the same result... but it will just pull out of the union.
