Kosova has quite a few opportunities to go around Serbia and put it into a corner.
Why they did not do it is because who can do that (Pacolli) is not an expert of everything.
As his colleagues he can't rely on himself on everything.
The ones on Serbian side and the ones on Kosova side who should be experts (I am thinking of Railway ministers for instance) are complete idiots.
I can't say you with 100% about the Albanian part - but several years ago I had the misfortune to talk with a "responsible" person on Serbian side.

I told them that legally there is a horribly weak point and Kosova can attach Serbian position if they do not act diligently. I outlined the exact problem - and that Pacolli can eat them for dinner.
The response of the Serbian guy was:
1) We can't do really much because that position is what the West expects from us (total BS!)
2) I am totally drunk now, I have to be in Belgrade in the evening, driving all the way from Budapest.
