Hague prosecution expects chamber to "monitor Šešelj"

Asked if steps would be taken "because of Šešelj's political activities and behavior" Magdalena Spalinska told a regular news conference that the Trial Chamber has the discretion to take any decision it considers suitable in relation to Šešelj's release.

Spalinska noted that the Trial Chamber has set two conditions when granting Šešelj temporary freedom - that the accused does not come into contact with the victims and witnesses, and that he must return to the Tribunal when the Chamber orders him to.

Radio Free Europe reported, quoting the Hague Prosecution, that Šešelj was set free by the Chamber "with no conditions, on its own initiative, and without consulting with the prosecution."

According to this, the prosecution "assumes that the Chamber is monitoring the situation, that it is familiar with Šešelj's statements and will take measures it deems necessary."

According to the agency, "this suggests that only the judges who released Šešelj are responsible for the possible punishment over his public appearances last week, which according to the practice of the Hague Tribunal can be considered as influencing the victims and witnesses."

"Many reactions to Šešelj's statements refer to the potential negative impact on regional stability and reconciliation. The prosecution shares that opinion," Radio Free Europe quoted the prosecution.

The article added that "Hague indictee and Croatian police general Mladen Markač was in 2011 arrested and transferred to The Hague because he violated the conditions of his provisional release having gone hunting with friends."
