The Bosnian Court of Appeal ordered Branimir Glavas’s release from custody yesterday. The decision was taken after Glavas’s legal team submitted an appeal to the first instance court’s ruling to place the convicted war criminal in extradition custody for one month. Glavas custody decision overturned The prosecution had asked for Glavas to be remanded in custody and for an inquiry to be conducted into the circumstances in which he was granted Bosnian citizenship. On May 8, Glavas was sentenced to 10 years behind bars for war crimes against Serb civilians in Osijek in 1991. Within hours of the verdict being delivered, he fled to Bosnia-Hercegovina, whose citizenship he was granted in 2008 on the basis that his parents hailed from Hercegovina. The first instance court’s ruling that the prosecution has 40 days to submit an extradition application to Croatia remains in force, however. The court accepted the fact that Glavas had legally gained Bosnian citizenship on October 22 last year, but concluded that the move had been a clear ploy to avoid serving a prison sentence for war crimes. “The trial chamber confirmed that Branimir Glavas is a citizen of Bosnia-Hercegovina, that he is registered at an address in Ljubuska, and that his freedom will not jeopardize the course of the extradition process that is continuing,” said court spokeswoman Manuela Hodzic. “The trial chamber has established that there is no possibility of him absconding,” she said.

The prosecution had asked for Glavaš to be remanded in custody and for an inquiry to be conducted into the circumstances in which he was granted Bosnian citizenship.
