New charges against Karadžić

The Hague Tribunal Trial Chamber will allow the prosecution to submit one more proposal for additional changes to the indictment against Radovan Karadžić.

The Hague Tribunal Trial Chamber will allow the prosecution to submit one more proposal for additional changes to the indictment against Radovan Karadzic. At the same time, the Trial Chamber scheduled the next status conference for Tuesday, March 3, according to a statement from the Hague today. New charges against Karadzic The prosecution brought the court new proof in connection with one of the charges at the last status conference on Feb. 21 and asked the court to reconsider its decision about rejecting some of the new charges. The Trial Chamber allowed the prosecution to supplement its proposal, saying that it would reconsider its decision on the altered, third indictment, and that the former Republic of Srpska (RS) president would be allowed to plea to all the new charges. Besides the proposal for the additional counts on the indictment, other administrative-technical issues in the case against Karadzic will be discussed at the status conference, such as the publication of evidence and preparations for his defense. The new indictment against Karadzic was initially rubber-stamped by the court on Feb. 16. He is charged with genocide against non-Serbs in Srebrenica and 11 other districts in Bosnia-Herzegovina, as well as persecution, extermination, murder and other crimes against Muslims and Croats from 1992 until 1995. The proposed new indictment, which the prosecution submitted at the end of September, was accepted by the court almost in its entirety, with only three additional counts of murder being rejected. The prosecution, however, filed an appeal against the court’s decision. Two of the counts against Karadzic are for genocide, while the remaining nine counts are for expulsion, extermination, murder, deportation, inhumane acts, terrorizing the civilian population, illegal attacks on civilians and taking international hostages. The charges against Karadzic focus on ethnic cleansing in Bosnia-Herzegovina from 1992 to 1995, terror against civilians during the siege of Sarajevo during the same period, taking UN hostages in May and June 1995, and genocide in Srebrenica in June 1995. Those criminal acts, in addition to genocide, include five counts that qualify as crimes against humanity, and four for violating the laws or customs of war. Although the number of counts in the indictments stays the same—11—the prosecution believes that four counts in the altered indictment are new, meaning that Karadzic would be allowed to enter a plea for them. Karadzic was arrested on July 21 in Belgrade and he refused to enter a plea to the charges in his appearances before the Hague at the end of June and August.
