It is still not clear whether Radovan Karadzic’s appeal was ultimately submitted by his lawyer. B92 has made a number of attempts to find out more, but Karadzic’s lawyer Svetozar Vujacic has been unavailable for comment. Uncertainty over Karadzic’s appeal He earlier announced that he would be submitting the appeal by post by recorded delivery. Provided Vujacic submitted the appeal within the legal deadline of three days that expired at midnight, the court will consider that it has arrived on time. The lawyer told Tanjug at 19.00 CET that he would not confirm whether the appeal had been lodged, stating that withholding this information was “part of the defense strategy”. Vujacic said that he would be submitting the appeal by recorded delivery, adding that he did not want to go into any more details as this was the agreement with his client. The deadline for submission of the appeal is three full days, which means that in Karadzic’s case, the appeal had to arrive by midnight. In Serbia, the last post is usually at 20.00 CET on working days, and the date and time of the appeal’s submission at the post office is considered to be the time the court receives it. When the appeal reaches the court, it is then ascertained whether the appeal was submitted in a timely manner by checking the postmark. When the court receives the appeal, the War Crimes Chamber then has three further days in which to take a decision. Should, as expected, the appeal be turned down, the court’s ruling is passed on to the Justice Ministry which takes the decision to extradite the accused, which is carried out by the Interior Ministry. The former Bosnian Serb leader and one of the world’s most sought-after fugitives was arrested in Belgrade on Monday, July 21, after 13 years on the run.
