The student organization stated that it has obtained the necessary conditions for this, since there has been no information on Mladić in the last five years, and based on the Extrajudicial process Law, the process can be initiated.

The students state that the time which has passed since he has disappeared and the serious health problems recorded in his medical records, propose the possibility that Mladić is no longer among the living, the organization stated.

The direct legal interest for initiating the proposal is seen by the students through the fact that the arrest of Mladić is a prerequisite for Serbia’s entrance into the EU, and that this obstacle could be avoided by proclaiming him deceased.

Article 57 of the aforementioned law states that a personal can be proclaimed deceased. The individual must be 70 years old in order to be proclaimed decease if no information on the individual has been available in the last five years.

The same procedure is used for missing persons cases. A person can be proclaimed decease if they disappeared in a shipwreck, a traffic accident, fire, flood, earthquake or another situation of extraordinary, life-threatening conditions. It is necessary that to first have no information regarding the person for at least six months.

However, Mladić does not even meet the first criteria, since he is 64 years old, and information from the people accused of helping him hide states that they were in contact with him and helping him hid from the authorities last year.
