Justice minister rules out new election of judges

Justice Minister Snežana Malović said that the decision of the Constitutional Court will be respected, but the election process of judges will not be repeated.

Justice Minister Snezana Malovic said that the decision of the Constitutional Court will be respected, but the election process of judges will not be repeated. She denied that the High Judicial Council began preparation for individual explanation of why certain judges were not reelected only after pressure from the European Union. Justice minister rules out new election of judges Malovic said that he Constitutional Court’s decision on the appeals of judges that were not elected will be respected, but that this will not facilitate a general repeating of the process of the election of judges. The Constitutional Court was given the reasons of the Council for why some judges were not reelected. Malovic said that there were many different reasons stated, from the fact that some candidates were not working effectively to personal reasons, such as one judge not being reelected because they were convicted in a domestic violence case. “There are currently 81 open positions. The Hugh Judicial Council stated at its meeting last week that the number of judges should be increased by another 104. These are the places where some judges whose appeals were adopted will be able to return,” Malovic said. She added that it was already stated many times that there will be no repeating of the election process. “It is a good thing that the decisions of the High Judicial Council and State Prosecution’s Council are being questioned. I do not think that this depends on pressure, because I am convinced that the Constitutional Court did not come to this conclusion because of pressure from the EU,” she said. Malovic said that officials of the society of judges agreed that reforms of the judicial system are necessary and that the election of judges and prosecutors is only one segment of the process. “The essence of reform remains an independent, effectively transparent and objective judicial system, that will deal more intensively with the fight against organized crime and corruption,” she said.

Malović said that he Constitutional Court’s decision on the appeals of judges that were not elected will be respected, but that this will not facilitate a general repeating of the process of the election of judges.
