Ban Ki-moon has today sent an official letter to the EU regarding its mission in Kosovo, B92 has learned. In the letter, the UN secretary-general writes that "some UN Security Council members" object to the EU plans to transfer UNMIK's jurisdiction to its mission, dubbed EULEX. UN chief to EU: Kosovo mission problematic The European Union has earlier this month decided to approve and start deploying the mission despite objections from Serbia and Russia, who say the mission is illegal under valid UN Resolution 1244. Last week, European Commission President Jose Manuel Barroso said that EULEX is "not contrary to UN Security Council Resolution 1244 and international law". The EU document defining the legal basis for sending the mission quotes a section of paragraph 10 which says that Resolution 1244 "authorizes the secretary-general, with the assistance of relevant international organizations, to establish an international civil presence in Kosovo." But the second part of that paragraph reads, "in order to provide an interim administration for Kosovo under which the people of Kosovo can enjoy substantial autonomy within the Federal Republic of Yugoslavia [FRY]." The FRY successor state is the Republic of Serbia. It was also interpreted that Ban Ki-moon must first invite any international organization to do so, which he so far has not done. Last week, Barroso denied that this brought the EULEX legality into question, and said the secretary-general "officially did not oppose the sending of the EU mission".
