“This is of great importance and it can be said that the old constitution lacked legality and did not secure broad autonomy for Kosovo, while the new constitution does just that. Therefore I believe the international community should recognize that the Serbian people have accepted this constitution”, Fleiner said.He believes the negotiating process so far has yielded no results and added that the parties are not to blame for this, rather the atmosphere of “unless you find a solution, someone else will do it for you”.
“If the international community accepts that Kosovo’s status solution must be reached through negotiations, there needs to be agreement from both sides and I think the decision should be delayed until after the spring next year. I don’t think there will be a consensus-based decision until then”, Fleiner said.
Fleiner also said Russia took the negotiating process seriously, and could use its veto powers in the UN Security Council if it fails to persuade the U.S.
According to Fleiner, Kosovo could represent a case with horrible consequences for the world, making conflicts more brutal, where secessionists would seek to internationalize their problems in order to have the UN grant them independence.
Asked about Serbia’s options should Kosovo be granted conditional independence, Fleiner said that a situation where individual countries recognized Kosovo’s independence would amount to anarchy, since the Security Council resolution 1244 provides for Serbia’s sovereignty over her territory.
Another consequence of such a decision would be the pressure brought on Serbia, where countries could “blackmail it saying, unless you do this, we will recognize Kosovo”.
“I think that should Kosovo become an independent state, it would have to convince the Serbs there that their home is in Kosovo. I have so far seen no sign of this. I see no proof of Albanians convincing Serbs they should feel Kosovo is their country”, Fleiner concluded.
