“Judges have not had their own protection until now, in the sense that they did not have who to complain to. According to the constitutional proposal, they have the right to appeal to the Constitutional Court.” Stojković said.On the other side, Serbian Judges Association President Dragana Boljević told B92 that the regulations of the new constitution include unacceptable methods of electing the senior officials of the court council. After a three year working trial, judges are then given lifelong mandates.
“According to the constitutional proposal for the Senior Council, which is made up of 11 people, there will be three ministers from the Government, one Court Council president and one Supreme Court President, which gives you two respected legal experts. The other six will be judges, but we think that the fact that the parliament is electing them will be problematic. The writers of the constitution did not try to state the way in which the parliament will elect these judges, because if there is no clear criteria for the judges to be elected, then there will be more problems with the Senior Council.” Boljević said.
