“Statute must be harmonized with new law”

BELGRADE -- Former Constitutional Court President Slobodan Vučetić said that the Vojvodina statute proposal must be harmonized with the laws for transferring authority.

The draft law for transferring powers to the province is expected to be adopted on Thursday by the government, while the statute itself has been waiting for adoption in parliament for over a year now.

Vučetić told daily Politika that he believes that this harmonization will be more than just a technical-legal question.

“These are not some kind of corrections in the wording of the statute; rather, it must be harmonized with the law for authority which is to be passed in parliament. That is why I am expecting an agreement between the provincial and state governments for pulling the statute draft from procedures in the Serbian parliament and vote on a new draft in the Vojvodina assembly,” he said.

Vučetić explained that the statute and law drafts should be prepared at the same time and in a synchronized fashion, "though it would be better for the law to be adopted first".

“This way, the Vojvodina assembly went one step ahead, respecting the deadline set by the constitutional law, but probably wanting also to prejudge some solutions, and passed the statute draft before preparations of the law even began."

"Since there are several decrees in the statute that appear to be unconstitutional, the state government tried to fix that with the law by obligating Vojvodina to change the statute,” Vučetić said.
