Fleiner: Resolution 1244 only legal basis

FREIBURG -- Thomas Fleiner says that UN Resolution 1244 remains the only legal basis for Kosovo negotiations.

The Serbian Kosovo team legal adviser told Tanjug news agency on Thursday that the resolution 1244 is included in the legal foundations of the ongoing talks.

"Every decision that would step out of that framework will require a consensus of both sides and an amendment to Resolution 1244," clarified Fleiner, who is Professor of Constitutional and Administrative Law at the University of Freiburg, Switzerland.

Fleiner is disappointed over the fact that the international Troika, made up of representatives of the EU, Russia and the U.S., Wolfgang Ischinger, Aleksandr Botsan-Kharchenko and Frank Wisner, had so far refused to present their opinion on the contents of 1244 and its implications on the status issue, or to request an independent expert opinion in that respect.

"The text of the resolution is quite clear to any lawyer and it calls for respect of sovereignty and search of a solution for Kosovo only within the essential autonomy framework," said Fleiner.
