The trial of those accused of killing 48 Albanians in Suva Reka in 1999 will highly likely start anew. The reason for a retrial will be a change in the structure of the trial chamber, as Judge Gordana Bozilovic Petrovic will no longer be a part of the tripartite chamber, since the Belgrade District Court President Sinisa Vazic relieved her from that duty. Suva Reka process likely headed for retrial The Criminal Code says that the trial must in that case start again, with the indictments read and the defendants re-entering their pleas. The Trial Chamber may decide whether or not the witnesses will be summoned to give testimonies again. The code envisions that written transcripts of their previous testimonies can be read out in the course of the restarted trial. The trial began on October 2, 2006. The indictment charged eight former MUP officers with the crime. Former deputy Nis special police commander Radoslav Mitrovic is accused of giving orders that led to the war crimes allegedly committed in Suva Reka. Along with him, then-commander of police forces in Suva Reka Radojko Repanovic and his deputy Nenad Jovanovic also stand accused. Suva Reka police officers Sladjan Cukaric, Miroslav Petkovic, Zoran Petkovic and Ramiz Papic, along with state security (DB) official Milorad Nisavic are also charged with the crime committed on March 26, 1999, during the NATO bombing campaign against Serbia. According to the indictment, the defendants shot dead several elderly members of the Berisha family, detaining the remaining men, women and children in the Kalabrija pizza parlor, into which they then threw two hand grenades. The suspects then allegedly went on to kill anyone showing signs of life.

The Criminal Code says that the trial must in that case start again, with the indictments read and the defendants re-entering their pleas.
