Amendments detailing surveillance procedures adopted

The Serbian parliament on Wednesday passed amendments to the law on the Military Security Agency (VBA) and the Military Intelligence Agency (VOA).

BELGRADE The Serbian parliament on Wednesday passed amendments to the law on the Military Security Agency (VBA) and the Military Intelligence Agency (VOA). According to the new legislation, all future surveillance of electronic communications can only be done with permission from the court. Amendments detailing surveillance procedures adopted The bill received support from 171 MPs from the ruling coalition and the opposition Democratic Party (DS) and the Liberal Democratic Party (LDP), while ten lawmakers voted against it. The new law is harmonized with the opinion issued by the Constitutional Court of Serbia and is more respectful towards human rights and liberties, the government said in a release. The government approved eight draft amendments, including one from Ombudsman Sasa Jankovic who proposed that the VBA and VOA's right to forward information to civilian security services and the police be limited to matters of national security and the most serious crimes. Another of the adopted amendments came from the Democratic Party of Serbia (DSS), which asked that special actions and measures be taken based on a written and substantiated warrant issued by the VBA director or a VBA employee authorized by the director, and that a register be kept of the issued warrants. The government did not accept a proposal from the same party to obligate VBA and VOA members to refuse illegal orders, or instructions from their superiors if following them would mean committing a crime.
