Constitution must be respected, president says

Anybody who does not respect the Constitution and opposes decisions of the Constitutional Court needs to be held responsible, President Tomislav Nikolić says.

BELGRADE Anybody who does not respect the Constitution and opposes decisions of the Constitutional Court needs to be held responsible, President Tomislav Nikolic says. He said this commenting on statements of certain politicians regarding the Constitutional Court’s decision to declare certain rulings of the Law on Determining the Jurisdiction of Vojvodina unconstitutional. Constitution must be respected, president says “It is especially unacceptable for politicians to comment on the Constitutional Court’s decisions,” the president told weekly Pecat and added that the judges’ job was to make decisions in accordance with the Constitution and that politicians should “accept them and continue to work in politics or not accept them and leave the politics”. “Jurisdiction of the Vojvodina Statute is unconstitutional and I wish the Constitutional Court made the decision right away,” Nikolic pointed out. “We cannot have quasi states within Serbia,” he said and added that this was a “big test for the Democratic Party (DS) which needs to stop its Vojvodina officials who speak against the Constitution, the country’s highest legal act”. Pointing out that such reactions represented an attempt to destroy the rule of law, the president said that such attempts should be prevented and sanctioned but that he did not know “whether the state was capable of punishing politicians who act contrary to the Constitution”. According to him, when someone says that the illegal state of Kosovo should be recognized or that some decision of the Constitutional Court is political and that they will not accept it, “then the prosecutor is the one who should assess whether there is some illegal behavior there or if it is a freedom of speech”. Commenting on the Constitutional Court’s decision to accept complaints of non-elected judges and prosecutors, Nikolic said that the ruling could not have been made any faster because parliament had been avoiding submitting its response to the court. He added that the European Parliament, European Commission and the Constitutional Court had presented reports on the situation in the Serbian judiciary and wondered what else needed to happen in order for the authorities to realize that it was necessary to implement the judicial reform.
