Constitutional Court rules in favor of 120 judges

The Constitutional Court of Serbia has ruled in favor of 120 laid off judges who filed complaints.

BELGRADE The Constitutional Court of Serbia has ruled in favor of 120 laid off judges who filed complaints. The Constitutional Court made the decision after determining that the presumption of them meeting all the requirements for appointment as judges was not disproven when the decisions regarding their complaints were made. Constitutional Court rules in favor of 120 judges The court invalidated the decisions by the High Judicial Council that rejected the complaints by the plaintiffs regarding the decision to relieve them of duty, says the court's website. The court ordered the High Judicial Council to re-appoint the plaintiffs within 60 days of receiving the decision, in accordance with article 30 of the rules for implementing the decision on determining the criteria for competence, skill and worthiness and for the procedure of reviewing the decisions by the original High Judicial Council on terminating judicial office. Around 450 complaints by laid off judges and prosecutors have been filed to the Constitutional Court to review the decisions by the High Judicial Council and State Council of Prosecutors. More than 120 public sessions have been held regarding these cases since March 14, and 90 percent of them have been closed. Officials of the State Council of Prosecutors attended nine of them, while no one from the High Judicial Council took part in any of the sessions. Considering the number of sessions, the court had the opportunity to consider all the faults of the procedure and decide on the constitutional and legal issues at hand, and it based its first decisions on that. The review of the decisions by the State Council of Prosecutors was completed last year, when the new council decided in favor of 33 complaints that had been filed, while denying 129, so 126 prosecutors again filed complaints to the Constitutional Court. The new High Judicial Council completed its review in late May and granted only 98 out of 752 complaints by judges that had been let go.
