"Referendum on Kosovo and EU would be unconstitutional"

Opposition DSS party leader Vojislav Kosunica says any referendum "choosing between the EU and Kosovo" would be unconstitutional, illegitimate and illegal. The citizens cannot be asked to state their position "on the handover of Kosovo" in a referendum, the constitutional law expert who served as Yugoslav president and Serbian prime minister said in a statement for the media on Monday. "Referendum on Kosovo and EU would be unconstitutional" Kostunica added that "anyone who wishes to hand Kosovo over to Albanians would need to change the Constitution first, instead of calling an illegal referendum on the choice between the EU and Kosovo". The DSS leader noted that Brussels presented Serbia with the choice between Kosovo and the EU as far back as 2008, when a majority of EU members recognized Kosovo's illegally declared independence, and recalled that this is the reason why the government - headed by him - was dissolved the very same year. Kostunica believes that Serbia has been following a path that has no alternative for three years now and that the incumbent government insists on the policy according to which the EU is the country's top priority, instead of defense of territorial integrity. He believes this policy to be seriously dangerous for Serbia's national interests. Kostunica expressed belief that the best policy is the one that derives from and is in keeping with the Serbian Constitution, and the Constitution explicitly states that Kosovo is an integral and unalienable part of Serbia. "This is the reason why calling a referendum where people would need to choose between Kosovo and the EU would be unconstitutional, illegitimate and illegal," Kosunica underscored. Koštunica added that "anyone who wishes to hand Kosovo over to Albanians would need to change the Constitution first, instead of calling an illegal referendum on the choice between the EU and Kosovo".
