“Serbia’s question formulated well”

Serbia’s chief legal representative in The Hague, Sasa Obradovic, rejected criticism that Serbia’s demand to the ICJ was poorly formulated. Some international law experts have stated that the question that was asked of the International Court of Justice (ICJ) did not enable the court to give its opinion on the right of the Kosovo Albanians to secede from Serbia. “Serbia’s question formulated well” Obradovic told B92 that it is important to formulate the demand that Serbia would be submitting to the United National General Assembly. “I think that we must not be naïve. If the question was posed differently, the case would have lasted longer. The formulation of the court would have been different, but after this decision of the ICJ, taking everything into consideration, I think that we should not be naïve and believe that the outcome would be any different,” Obradovic said. He said that it is most important now to formulate a demand for the UN General Assembly, which is both a political and legal task. “The political moment is more important before the General Assembly, because the formulation must be one that would garner the support of the majority of UN member-states, and that is a very important situation.
