District Court quashes ruling in Marko Milošević case

The Pozarevac District Court yesterday quashed the Municipal Court’s decision to drop charges against Marko Milosevic and several of his colleagues. The case in question was a private action brought by the late Otpor activist Radojko Lukovic against Milosevic and his cohorts on charges of committing grievous bodily harm. District Court quashes ruling in Marko Milosevic case Lukovic died in a traffic accident on July 10, 2008, and was one of three Otpor activists who were brutally assaulted by Milosevic and several of his colleagues in an altercation in 2000. As none of his legal heirs took over the case within the legal deadline of three months following his death, Judge Gordana Vidojkovic decided to close the case. However, because the Municipal Court would have to establish responsibility for the injuries to the Otpor activists in any retrial, the District Court quashed the decision, stating that any move to drop the charges could only be considered after such time. The District Court took its decision on May 19, and Lukovic’s legal representatives received it on Thursday. After the District Court overturned the not guilty verdict for Milosevic and his colleagues in February, Judge Vidojkovic is expected to schedule a new hearing. Momcilo Veljkovic, who was injured in the incident nine years ago, believes that the court’s decision is a ploy to postpone and protract the trial, so that, ultimately, the charges against Milosevic and his five friends expire. “The charges expire on May 2, 2010, when ten years will have passed since the attack. We cannot gain justice because of the obstruction of the Pozarevac court system and the wishes of higher instances, stemming from the political agreement between the people currently in power, made up of the Democrats and Socialists,” Veljkovic lamented.

Luković died in a traffic accident on July 10, 2008, and was one of three Otpor activists who were brutally assaulted by Milošević and several of his colleagues in an altercation in 2000.

As none of his legal heirs took over the case within the legal deadline of three months following his death, Judge Gordana Vidojković decided to close the case.

However, because the Municipal Court would have to establish responsibility for the injuries to the Otpor activists in any retrial, the District Court quashed the decision, stating that any move to drop the charges could only be considered after such time.

The District Court took its decision on May 19, and Luković’s legal representatives received it on Thursday.

After the District Court overturned the not guilty verdict for Milošević and his colleagues in February, Judge Vidojković is expected to schedule a new hearing.
