The number of persons wiretapped by Serbia’s secret services is unknown and has been speculated about for decades, the daily Danas writes. The Belgrade newspaper reports today that the Security-Information Agency (BIA) has responded to the request filed by the Youth Initiative for Human Rights about the number of individuals this agency has wiretapped, by saying that it is not able to deliver the copy of a document containing this data. Unknown number of wiretappings BIA also said in its answer that there is no legal basis for the agency to have a document of this kind. The NGO's official Dragan Popovic says that even though they did not receive the answer, “this is a big deal, because after three years BIA has decided to give some sort of response”, and added that he "still thinks" it is impossible that the agency does not have data on the number of wiretappings. Serbia’s Supreme Court rejected a BIA appeal in 2006, protesting a public information ombudsman's decision to submit this information. However, the agency only acted on the order recently, although it was given a three-day deadline at the time. The Law on Criminal Proceedings states that warrants for secret monitoring of conversations can only be issued by investigative judges, on the written and explained request from public prosecutors. Wiretapping and recording may not last longer than three months, but the law states that under emergency circumstances, it can be prolonged for another three months.
