Regardless of Serbia’s new constitutional definition, analysts say Kosovo status will be decided elsewhere.

Essential or declarative Kosovo position?

All the state institutions will be obligated to support and protect Serbian interests in Kosovo in all internal and foreign political relations.

Dragor Hiber, representing the president, and minister Zoran Lončar, representing the government, will work to harmonize the text of the new constitution. Lončar says the harmonized version must then be agreed on by all the relevant political factors. “The new constitution will take its final shape after taking into account the positions of the Radicals and the Socialists”. He says such decision will strengthen the Serbian position in the Kosovo status negotiations, testifying to the full unity in the Serbian ranks.

However, Center for Non-Violent Resistance analyst Nenad Đurđević told B92 this government’s decision cannot significantly influence Kosovo talks, but will make the future relations with Kosovo and the international community difficult. “It’s quite possible this is directed toward creating an internal cohesion around the new constitution issue, and sending out a strong message to the international community that Kosovo’s independence would lead to a destabilization of Serbia”.

Đurđević says although this is a strong message, it is not legally binding. What it means is that the Kosovo future status decision is still in the hands of the international community, Đurđević concluded.
