ICJ rejects Georgia’s suit against Russia

The International Court of Justice (ICJ) has refused to hear complaints in the proceedings that Georgia launched against Russia. Georgia is accusing Russia of “ethnic cleansing” in South Ossetia and Abkhazia. ICJ rejects Georgia’s suit against Russia The ICJ ruled today that it had no jurisdiction to hear the case because Georgia never attempted to settle the dispute before bringing it to the court, as required under the treaty. Russian representatives have expressed their satisfaction with the ICJ’s decision. “We are absolutely satisfied with the ICJ decision,” said Russian Foreign Ministry Legal Adviser Kirill Gevorgian, while Russian Ambassador to the Netherlands Roman Kolodkin said that Russia “won the case”, Russian news agency Itar-Tass reported. “The court completely agreed with Russia’s main thesis. We said that it was not competent to consider the case. The court reached the conclusion with ten votes in favor and six votes against. The case is closed,” he pointed out. Georgian representatives have, on the other hand, expressed their disappointment with the UN court’s decision. Georgian First Deputy Justice Minister Tina Burjaliani put down Georgia's legal defeat to "a procedural technicality" and said the ruling was a disappointment for her country. But she did not rule out a possibility that Tbilisi would address the ICJ regarding the same matter in the future. Georgia filed the suit to the ICJ on August 12, 2008, shortly after a conflict broke out between Russia and South Ossetia.

The ICJ ruled today that it had no jurisdiction to hear the case because Georgia never attempted to settle the dispute before bringing it to the court, as required under the treaty.

Russian representatives have expressed their satisfaction with the ICJ’s decision.

“We are absolutely satisfied with the ICJ decision,” said Russian Foreign Ministry Legal Adviser Kirill Gevorgian, while Russian Ambassador to the Netherlands Roman Kolodkin said that Russia “won the case”, Russian news agency Itar-Tass reported.

“The court completely agreed with Russia’s main thesis. We said that it was not competent to consider the case. The court reached the conclusion with ten votes in favor and six votes against. The case is closed,” he pointed out.

Georgian representatives have, on the other hand, expressed their disappointment with the UN court’s decision.
