RS: Constitutional Court upholds decision on referendum

Thus, the RS Constitutional Court rejected the veto of Bosniak (Muslim) representatives to the decision of the RS National Assembly to call the referendum, which means that the decision can come into force.

The decision to call the referendum does not relate to members of any constitutive people individually and does not contain specific provisions that discriminate or favor members of some of those peoples, the Council said.

The release issued by the Constitutional Court says, among other things, that the decision does not have a national connotation, but rather refers to all citizens that can use their right to take part in the referendum freely, regardless of their nationality.

On July 15, the RS National Assembly passed the decision to call the referendum on the Court and Prosecution of Bosnia-Herzegovina.

Under the decision, the referendum question says: “Do you support the unconstitutional and unauthorized imposition of laws by the High Representative of the international community in Bosnia, especially the laws on the Court and Prosecution of Bosnia-Herzegovina and enforcement of their decisions in the territory of the RS?”
